Chief: Home-invasion shooting 'clearly self-defense'(NC)

Charlotte-Mecklenburg Police Chief Rodney Monroe said Wednesday that a shooting involving a man who killed a would-be burglar who was kicking down his girlfriend’s apartment door was “clearly a case of self-defense.”

It took detectives and prosecutors a matter of hours to determine that the shooting Tuesday in a quiet east Charlotte neighborhood was within the boundaries of the law.

“The (shooter) was defending himself and his property from a criminal act,” Monroe told the Observer. “It was clear he was protecting himself.”

Self-defense laws have come under scrutiny in recent months after the fatal shooting of Trayvon Martin, 17, in Florida by an armed neighborhood watch volunteer.

North Carolina’s “castle doctrine” law, enacted last year, expands the rights of residents to use deadly force to protect themselves if they fear for their lives.

The “castle doctrine” provides protection from criminal and civil penalties for those who use guns to defend themselves in their homes, cars and workplaces. The law also expands the number of places where someone with a concealed-handgun permit may carry their firearms, including state parks and rest areas.

Mecklenburg District Attorney Andrew Murray has said the law covers anyone “who uses deadly force to legitimately protect themselves from harm or death.” However, if the evidence shows excessive force was used, he said, prosecutors could indict the shooter for murder.

“We have to evaluate the situation – the facts – to determine if the person used deadly force because they had a real fear of bodily harm or death,” he told the Observer recently. “We’ve got to look at the evidence and whether the force used was necessary given the situation.”

In the east Charlotte case, the shooter was alone in his girlfriend’s home on Rolling Hill Road at the time of the shooting.

Homicide detectives say the shooter had seen a car in the driveway and spotted a person walking to the back of the house. A short time later, he heard someone trying to kick in the rear door.

The man yelled that he was at home, but the intruder continued to kick at the door. At that point, the man inside fired one shot through the back door, police say, striking Anthony Michael Aykroid, 23. Aykroid was pronounced dead at the scene.

Police said Aykroid’s girlfriend, Krystina Michelle Misskelley, 25, told investigators she drove Aykroid to the home, where the couple intended to steal property. She was waiting outside with the car running as Aykroid was shot, according to police. Misskelley was charged with attempted breaking and entering and was being held in the Mecklenburg jail in lieu of $15,000 bail. In 2005, Misskelley was found guilty of possession of drug paraphernalia.

Police did not release the identity of the shooter, but NewsChannel 36, the Observer’s news partner, cited neighbors who identified him as Brad Griffith. They said he was a military veteran who recently returned from Iraq. According to the State Bureau of Investigation, Griffith was issued a concealed-weapons permit Sept. 15.

A woman who answered the phone at a number listed for Griffith said he wasn’t available, then hung up.

What ever happened to taking your girlfriend out for dinner, or a movie?

But, more disturbing is the POS journalist who published the name and address of the shooter.

Maybe people should begin leaving their doors unlocked while they are at home. Saves the cost of a door - if it’s broken down by the excrement trying to invade, or from a bullet hole in this instance. Defending yourself should cost you nothing but the price of a bullet.

I couldn’t agree more. However, in this political climate I am very leery of the DA’s comments about needing to evaluate the facts of the case. I don’t know why, but after the Zimmerman arrest yesterday I find myself feeling little trust that those in law enforcement will do the right thing in the face of adversity.

It’s obvious from all the stories in here lately that a large number of home invaders are being shot, yet you’d never know that from national press coverage, which is promulgated by liberals who want the 2nd Amendment neutered.

Perhaps it the MSM would actually publicize the tremendous number of invaders shot each week by armed residents, the perpetrators would get a clearer picture of the risks and find another way to acquire wealth?

As things now stand, if they get their news from the MSM, breaking into a home seems nearly a risk-free endeavor. Just a thought.

However, if the evidence shows excessive force was used, he said, prosecutors could indict the shooter peasant for murder. “We have to evaluate the situation – the facts – to determine if the person peasant used deadly force because they had a real fear of bodily harm or death,” he told the Observer recently. “We’ve got to look at the evidence and whether the force used was necessary given the situation.”

Liberals are going after our rights to defend ourselves AND they're attacking neighborhood watch groups. Watch groups that were formed when the vast majority of police protection was siphoned off to babysit black communities. Honest citizens are forced to provide for their own safety and protection - buying home Security Systems and forming neighborhood watch groups.

This is wrong.

If we're not allowed to protect ourselves, neighborhoods should get equal police protection. OR pay for what we use - just like water or electricity. If people in the black community want to leave their outdoor hoses running - and not fix the faucet leaks in their homes - fine. But I don't want to have my water bill 'averaged' with theirs.

Same for police protection. If the black community becomes more lawless without 24/7 cops - ( hard to believe) they can install home security systems and create their own 'watch' teams. OR they can pay extra for police protection - BECAUSE I'M SICK of paying for cops to babysit their communities...

I have always said that the 2 best friends anyone can have are SMITH & WESSON. The way things are, any one that doesn’t carry their 2 best friend anywhere they go in or out side their homes are not very smart. Let’s face it, we are becoming and armed camp, and we are sitting on top of a powder keg, just waiting for someone to light the fuse. This is what this FAKE MESSIAH has brought us. No, not tremendous numbers, but enough to catch peoples attention. Your tagline says it all. The MSM does not want the ordinary person (peasant) to know that homeowners can successfully and legaly defend themselves against home invaders.

It has this predictable effect of changing their entire mindset.
