Ex-cop says sex faked in broadcast over radio (Claims explicit talk was protest of racism)

Before resigning last month as the Memphis officer heard on a police radio allegedly having sexual relations with a woman, Dion D. Anthony claimed that the encounter was a charade.

He claimed he faked sexually explicit comments and sounds with a woman and broadcast them to expose racism and unfairness in the Memphis Police Department.

Anthony, 37, raised the issues in an interview during an internal investigation at the department of the 58 seconds of sex talk broadcast over an open microphone on the police radio about 8:40 p.m. on March 12.

"I was not having sex on duty," Anthony said, according to a report of a March 21 interview with investigators that the department reluctantly released Wednesday.

"We was just talking; I wanted her ... to make a tape with me. I broadcast that on my own 'cause I'm sick and tired of ... what's going on," Anthony said.

"I'm sick and tired of being talked down to. I'm sick and tired ... of being taken advantage of and all the racism going on here."

However, Anthony failed to provide an address for a woman he would only identify as "Janice," the woman he claimed to have visited that night on or near Cochese, near Getwell and American Way.

Investigators couldn't find "Janice" and didn't believe Anthony's story. They concluded that Anthony, who said during the interview that he is married and has a baby girl and a boy, had sex with a woman while on duty.

"It is clearly a sexual encounter with a female that has nothing to do with racism or him being treated unfairly," investigators reported.

Anthony would have been charged with violating departmental rules governing personal conduct, lewd or obscene conduct, truthfulness and radio communications.

However, Anthony, who joined the police force in July 2007, resigned on March 22, the day after his interview.

Investigators reported that he couldn't be found to be summoned and that the administrative charges will be "held in abeyance" to be revived should Anthony seek to be rehired at MPD.

Michael Williams, president of the Memphis Police Association, said he was in the room when the department's Inspectional Services investigators interviewed Anthony.

Williams said that Anthony had never approached the union about issues of racism or unfairness.

Williams noted that the the department's director, Toney Armstrong, is an African-American, as are members of the command staff.

Of about 2,403 sworn officers in the Memphis department, 1,215 or 50.5 percent are African-American, according to Sgt. Alyssa Macon-Moore, a spokeswoman for the department.

"You can't continue to play the race card," said Williams, who also is an African-American. "For instance, if you have an issue and you never bring the issue forward, then how can that issue be addressed?"

During the 58-second recording of the police radio broadcast, a dispatcher repeatedly warned Anthony an "open microphone" was allowing anyone listening to hear the conversation.

That's odd. Mark Fuhrman made the same argument, and he was deemed a racist.

I believe the Tony Armstrong mentioned is the same Tony Armstrong who has appeared many times on the “First 48”. He seems like a great cop and was previously in the US Army.
