Police: Shooting Of Home Intruder Was Self-Defense(TN)

NASHVILLE, Tenn. - Police said a Nashville man acted in self-defense when he fatally shot a convicted felon who forced his way into his apartment in south Nashville.

Police said 35-year-old Michael Shane Martin was killed late Wednesday night at the Brentridge apartment complex off Bell Road.

Investigators said Michael Moffitt and his girlfriend, Caycee Albright, heard a knock at their door around 11 p.m. and Moffitt found the door peephole was covered. He told Albright to call police while he got an AR-15 rifle and opened the door once he saw it was uncovered.

Police said Martin charged in with a semi-automatic pistol and wearing a mask and gloves. Moffitt was shoved into an interior wall and opened fired, killing Martin.

A second masked man seen on the backside of the apartment building fled when he heard the gunshots. Police continue their efforts to identify him.

Albright said she knew Martin through friends and police think he might have come to rob Moffitt of his guns. Moffitt is a firearms enthusiast and had legal weapons in his apartment.

Albright was found to have an outstanding warrant charging her with leaving the scene of a property damage accident last year. She was arrested and released after posting a $5,000 bond.

Martin was convicted of six felony drug counts last November and received a seven-year probated sentence.

There is something called a badger game, wherein a girl gets close to a man, then sets him up for extortion/blackmale.

Be careful folks. Go slow with relationships. One thing these people are not is patient.

There is something called a badger game, wherein a girl gets close to a man, then sets him up for extortion/blackmale.

The KGB in the old USSR tried this with one of the female "honey pots." This was in the 60s and if memory serves me correct the intended victim was President Surkano of Indonesia.

There plan fell apart when he asked the KGB if they would make him a copy of the secretly filmed "sexcapade" to take back to Indonesia.

Happy ending. Can't tell if they were actually wrestling around in a hallway, say, but man!... If I'm grappling with a bad guy up close and personal, and he's got a pistol and I'm trying to maneuver a rifle in his direction while he's trying to point his pistol at me, that's gotta be a pucker moment! Good on the good guy.

Theoretical question: Did the good guy do anything wrong here? How should you respond to someone who you think is a bad guy on the other side of your front door... with a pistol in hand, a rifle in hand, or a shotgun in hand? I think I favor the shotgun. Should you approach the door, or should you stand back and take up a firing position and wait for him to force his way in? Just asking.

...what would qualify as illegal weapons? With the right paperwork you can own anything.

Every situation is different, and has to be evaluated on its own. However, I tend to favor having a pistol in hand for those late at night situations. For a home defense long gun, I like the AR type platform with a 30 round magazine and frangible bullets that tend to penetrate less walls than buckshot.

In this case the fact that the “girlfriend” knew the attacker is very suspicious.

I think opening the door was wrong.

When the perp starts breaking down the door you probably have justifiable cause for opening fire.

Of course, he was being flanked at the time and dealing with one of them prevented the second from attacking.

I'm also of that opinion. Don't like such "coincidences." At the very least, somebody's blabbing too much about Moffitt's guns, whether Moffitt himself or the girlfriend.

Nice point (well... truth be told, all were good points :)) about the flanking aspect of this situation. That's exactly the sort of tactical thinking I was looking for. I guess even Martin himself could have flanked Moffitt: he could've walked away from the front door and 30 seconds later been entering through a side window.

It's a situation I hope I NEVER find myself in!
