Man pardoned by Barbour charged in DUI-death case

PONTOTOC -- An Oxford man pardoned by Gov. Haley Barbour earlier this year has been indicted on three counts related to the 2011 highway death of 18-year-old Charity Smith.

Harry Russ Bostick, 55, turned himself in to Pontotoc authorities Friday and is free on $50,000 bond. He’ll be arraigned May 24 when formal charges will be read against him.

Bostick has been charged with driving under the influence, leaving the scene of an accident and DUI-death.

The indictment alleges that on Oct. 7, 2011, Bostick was intoxicated when his vehicle hit one driven by Smith on U.S. Highway 278.

Smith was killed and her sister seriously injured in the accident.

Last January, just before Barbour went out of office, he issued pardons, clemencies and other leniency for more than 200 people. Among them was Bostick.

The Parole Board investigated Bostick’s application for pardon from a felony DUI and sent a favorable recommendation to Barbour on Sept. 30. The crash happened the next month, and Barbour signed the pardon two months later on Jan. 10.

Parole officials and Barbour said they didn’t know about Bostick’s most recent DUI charge or the wreck because it happened after officials investigated the pardon request. Bostick was sentenced in May 2010 for his third felony DUI. He was sentenced to five years in an intensive supervision program. His pardon paperwork shows he was supposed to be in the drug program until March 2013. Barbour’s pardon erased that third DUI.

With the release of all those criminals, there will surely be more than a few recidivists to embarrass Barbour’s, um, charity and forgiveness.

Decades ago Barbour was an upcoming, savy politco with charm. Sorry to see him become a boob. What to gain by over doing the number of pardons and then this one?

Haley has made no apology, has no regrets?

Bostick wasn’t even in jail. He was under an “intense supervision program” which seems like something someone who has 3 DUIs would benefit from - why release him from that?

Christianity teaches that there are spiritual second chances, it doesn't ignore criminal actions.

Exactly, why can't people understand that even though there's spiritual forgiveness, you still have deal with earthly consequences of sin?

I don’t have time to do the required html and BOLD the first paragraph, but I hope there are people who will read it, instead of heaping so much scorn on Haley.

I’m so sorry for the pain this pardon has caused, and I’m sure he is, too.
