Jury finds man, 18, guilty in rape, burglary [of 87 yr old woman]

STOCKTON - An 18-year-old Stockton man was convicted Tuesday of raping an 87-year-old woman while he also burglarized her cottage home at O'Connor Woods retirement community Oct. 9, 2010.

Kunta Shaquille Ali Rigmaden will be sentenced to 15 years to life at a hearing to be held within the next 28 days. A San Joaquin County Superior Court jury found him guilty of rape and multiple counts of burglary. The jury could not come to a consensus on an additional count of sodomy, voting 11-1 in favor of conviction on that count after 21/2 days of deliberations.

Della Maggiore said she will inform the court June 16 whether the District Attorney's Office will attempt to retry Rigmaden on the sodomy count.

"The (jury) decided the main issue. They found him guilty of rape and of burglary, and that's really what this case is," she said.

Rigmaden's mother, Etosha Shoffner, said she plans to appeal the jury's decision.

"Where we go from here is up," Shoffner said. "The case was brought on a whole lot of garbage. My son's DNA was not found at the scene. It's bogus. It's lies."

Jury foreman Hawa Suahip said the panel - six men and six women - were confident in their decision.

"The process was fair and intense during 21/2 days of deliberations. People have a sense of value of themselves, so we didn't have to convince people; they had their own views," she said.

Anyone who would rape an 87 year old woman has totally abrogated any claim to membership in the fellowship of Humanity.
