Maybe Kagan or Sotomayor have told her what the result will be. I hope not, but to make such a bold prediction seems a bit crazy to me.

3. It is wishful thinking based on a faulty left-wing premise that the it be 5-4 and Roberts will cast the vote in favor to make the decision “Nonpartisan”.
I'd bet on Kagan, and I wouldn't be surprised if some of the other justices lied to her about how they'll vote just to find out who she'd blab to.
She swore she would still be speaker in November of 2010. To be fair, she was until January of 2011. We will see.
