The type of weapon used is relatively unimportant. If you are justified in using a firearm and deadly force, you are justified in using less levels of force.

It all depends on the wording of the applicable legislation. I bet some slimy lawyer or liberal judge (did I repeat myself?) would find a way to ignore it in a case like this.
