Mass. judge upholds Pledge of Allegiance’s ‘under God’

A Massachusetts judge has rejected a lawsuit that seeks to declare the words “under God” in the Pledge of Allegiance to be unconstitutional for schoolchildren to recite, drawing praise from those who said the pledge is in line with American traditions.

Schoolchildren who wanted to continue saying the pledge, their parents, and the Knights of Columbus defended the pledge with legal representation from the Becket Fund for Religious Liberty.

Diana Verm, legal counsel at the Becket Fund, said the decision is a “great victory for everyone who believes human rights come not from the whim of the government, but from a higher power, which is what the pledge proclaims.

Middlesex Superior Court Judge Jane Haggerty cited previous court decisions in upholding the words “under God.” She said the pledge is not a religious exercise but “a voluntary patriotic exercise” that teaches “American history and civics.”

Her decision came in response to a lawsuit from the secularist group the American Humanist Association, which said it may appeal to the Supreme Judicial Court, the state’s highest court.

The association’s president David Niose represented the plaintiffs in the case, a Massachusetts family who objected to the pledge.

Niose said June 11 that the pledge recitation “defines patriotism according to religious belief.”

Verm said that American Humanist Association members have the right to remain silent “but they don’t have the right to silence everyone else.”

Supreme Knight Carl Anderson of the Knights of Columbus said that the decision “kept faith with the foundational concept of this country,” the “unalienable rights” endowed by our Creator.

Four other major lawsuits have tried to remove the words “under God” from the Pledge of Allegiance, with none yet succeeding.

A Coney Island [Brooklyn, New York] principal has pulled Lee Greenwood’s “God Bless the USA” from a kindergarten “moving up” ceremony, out of concern that Greenwood’s patriotic song was age-inappropriate and potentially offensive.

“We don’t want to offend other cultures,” teachers quoted Greta Hawkins, the principal of the Edna Cohen School, as saying to defend her decision to nix “God Bless the USA” from the ceremony, the New York Post reports.

Greenwood’s song had been sung at previous school functions, and students in five classes reportedly spent months rehearsing for the moving up ceremony.

Department of Education spokeswoman Jessica Scaperotti told the Post that the song was indeed “too grown up” for the young students slated to be singing.

All you have to do is replace one word and the pledge remains historically significant and politically correct.

Replace "stands" with "stood".

Changing that one word changes everything, the pledge becomes a memorium, almost a lanert. Case in point ... The flag "did" stand for liberty and justice for all and the country "was" under God's care. Not any more, So quietly change the one word when you say the pledge to reflect what has happened... I now say "stood" even at the Tea Party meetings I attend, nobody but me notices.

If you think that God is no longer watching over and caring for America you have your head in the sand.

The examples of his caring are endless, from societies change in attitude towards abortion, the taking back of our rights to use deadly force against the forces of evil, the list goes on and on.

well..there's the problem: (JMHO :) this tiny group of (proto) MARXIST/NAZI/Commutards,
wish to silence any opinions/beliefs, that are contrary to their own..typically a liberal response.
btw..how appropriate the lawyer name is Robert Niose...shouldn't it be "Noise"
after all, this being a frivolous ($$$$ making) lawsuit against a gov't. school district

Oh stop it with the God talk ... I clearly stated that the country was at one time 'under God' but people today are trying to say God has nothing to do with it by wanting to take that OUT of the pledge. My comment is that it is too bad things aren't the way they were when people never questioned that GOD was running the country, not some lousy politician. I miss those days. I miss the days in which you could make the Pledge and not have to worry about if someone next to you heard you say "under God." I say it LOUDER than most people ... but I do say "stood" instead of "stands" ... When you see Obama surrounded by USA Flags, it makes you sick, they are a decoration to these people and do not have the meaning they have had for me for the last 70 years.

You brought up God, and stated that he was no longer caring for America. I simply pointed out the truth, along with some evidence.
