Madison - The state Judicial Commission was unanimous in its decision to file an ethics complaint against Justice David Prosser in January, but split 3-3 a month later on whether to reconsider the decision, newly released records show.
The commission went on in March to file the complaint alleging Prosser violated the ethics code for judges by putting his hands on the neck of Justice Ann Walsh Bradley during an argument in June 2011 Prosser contends he didn't violate ethics rules and that his hands touched Bradley's neck in a defensive reflex when she confronted him face to face.
The Judicial Commission is charged with enforcing the judicial ethics code, and much of its work is done in secret. But after the complaint was filed, Prosser waived much of the confidentiality surrounding the proceeding and sought records from the commission. The Journal Sentinel asked for the same documents under the state's open records law, and the commission in response posted them on its website http://www.wicourts.gov/courts/committees/judicialcommission/recordsrequest.htm Wednesday.
The records consist of meeting minutes that show how the commission voted, a transcript of Prosser's formal appearance before the commission and an audio recording of his informal appearance before the commission.
Meeting minutes show the commission voted 6-0 in January to file the complaint against Prosser.
The commission subsequently received a letter from Prosser's attorney, Steve Meyer, that noted justices who witnessed the altercation between Prosser and Bradley gave conflicting accounts. In a February meeting the commission debated the letter, but split 3-3 on whether to reconsider the decision to file the complaint.
A month later, the commission filed its complaint with the Supreme Court. The matter has been stalled ever since as Prosser has tried to force justices off the case because they witnessed the incident or for other reasons.

I don’t know why Prosser has not filed assault charges on Bradley. She flew at him in a rage, and all he did was put up his hands to defend himself. Why didn’t he file against her long ago, like when she first did. She was obviously setting him up. Step one, fly at Prosser like a mad witch. Step two, when he puts up his hands in fright and defense, claim he attacked her-opposite of the truth. Prosser is a smart guy. Why hasn’t he countered with charges...why why.
