Obama attorneys argue he's not Dem nominee (Klayman Florida NBC ballot challenge)

TALLAHASSEE, Fla. – Attorneys arguing on behalf of Barack Obama’s re-election plans today urged a Florida judge to decide that Obama is not yet the Democratic nominee for president and ignore evidence challenging his eligibility.

The arguments were raised by attorney Mark Herron on behalf of Obama in a hearing before Judge Terry Lewis in Florida, who is best known for presiding over the 2000 Bush v. Gore election dispute.

Lewis is credited with making crucial rulings in the contested 2000 presidential election when ultimately a Florida recount was halted by the U.S. Supreme Court, and George W. Bush was declared the winner.

Herron argued the Florida process affirms only that Obama is the choice in the state’s presidential preference primary but is not necessarily the party’s nominee for president.

But the judge noted that the party wrote to Florida’s secretary of state a letter indicating Obama’s name was the only one submitted, and he thought the state’s electors were bound to vote for him.

Like kevkrom says, "Standard Legal Tactic." The lawyers would be incompetent if they did anything differently.

Could be that it's a "Standard Legal Tactic" but those same lawyers are going to back in this same court once Obama in nominated so what have they really gained? I don't buy it. And neither would the Man on the Street if story ever managed to get to him. Which of course it won't.

Several posters here have said that the legal approach of Bambi’s attorneys would be standard no matter what, but I honestly don’t see how this could be the case if he could easily produce evidence that he was born here. Why not just do it?

Why does it matter where he was born if one of the parents was not a US Citizen? He may very well be a US citizen but we know he isn't a natural born citizen because the baby daddy was a Brit.

It's really just that simple - honest.

The Born in Hawaii meme is a red herring thrown to the masses who wouldn't know Article 2 Sect 1 from a jelly donut. It works really well, wouldn't you say? . .

It seemed to me (maybe wishful thinking) but at the end when the judge requested draft orders for him to use as an aid in preparing his own orders, he was first looking straight at Klayman when he made the request, as though he wanted the draft order from Klayman. Then he seemed to catch himself and to address the request to both sets of attorneys, seeming to be trying to appear balanced.

I think you have hit on something. Another possibility is that he or his minions have submitted so many forged documents to various review entities that they’re getting scared of the legal consequences of submitting a real document.

Hawaii accepted birth registrations from third parties, practically on hearsay, at the time of his birth, and it’s possible that if there is an actual certificate, it records the fact that it was filed by his grandmother. But still, that leads,to the question of why - and where he was really born. (I’m voting for British Columbia, personally.)

The WH released copies of a long form BC some months ago. Were they not able to give the original copy to his Florida attorney in time for this trial?

Obama's attorney's basically argued there is no opportunity for any court to review the eligibility of the nominee of a party for president, which Klayman argued could not have been the intent of the drafters of either the US or FL constitutions.

Before the primaries we made the case.
They said it wasn't the right time because he wasn't actually his party's candidate.

Before the main election we made the case.
They said it wasn't the right time because he wasn't actually the president elect.

Before the electoral college vote we made the case.
They said it wasn't the right time because he hadn't actually been elected until the electoral college said so.

Before the congress accepted the electoral college vote we made the case.
They said it wasn't the right time because he hadn't actually been approved until the congress accepted the electoral college vote.

Before was sworn in we made the case.
They said it wasn't the right time because he hadn't actually violated the constitution until he became president.

Now that he is in the White House, they say it's too late, you should have said something sooner!

It seems we've played this game before.

Worth repeating:

Why doesn’t the attorney ask BO’s attorney “Is Obama [Constitutionally] eligible to be President?”

I would love to hear the spin coming out of his mouth avoiding the question completely! In a courtroom, the lawyer would have to state the truth or ignore the question - thus dance around it!
