I think the real story here is that visa or whoever was hacked by this guy (or someone he knows) to allow his account to have unlimited overdraft. I don’t believe that he just happen to realize the mistake the same day. /tinfoil

15 months? That’s 1 month for every 100k he stole?

I really don’t see any deterrent to NOT do this, if this is the consequence. Except, I would just say I spent it all on drugs so there was no paper trail. Get out of jail in 15 months, and I’m on easy street.

The article does not discuss the income tax effects. The money that he illegally got from the ATM is included in his gross income under the claim of right doctrine. The net gambling losses are not deductible under Section 165. If he did not report the income on his return, he is looking at a 20 percent negligence penalty and six-year statute of limitations or a 75-percent civil fraud penalty and no statute of limitations.

Not condoning what he did but it does not seem like a crime, the bank allowed him to overdraw, a loan, which he did not pay back.

No different that people who took out large mortgages or HELOCs and did not pay them back, imho.
