In what can only be described as one of the most bizarre lawsuits ever filed, a New Jersey woman is suing an area 13-year-old because she suffered injuries after he made an errant throw at a Little League game. Making the case more extreme is the fact that the prospective defendant wasn't even 13 when he made the throw that accidentally struck the victim: He was 11. The accident which eventually led to Lloyd's suit came when a catcher, then 11-year-old Matthew Migliaccio, attempted to throw a ball back to a pitcher in the bullpen while he was warming up the reliever. Migliaccio's throw soared above the pitcher's glove and somehow escaped from the fenced-in bullpen at the Little League facility, eventually striking Lloyd in the face at the picnic table at which she was sitting.

Even if the woman loses, the kids parents will still be saddled with attorney fees. Nice.
When are we going to fix this crap. When these idiots lose, and they will, they should have to pay all leagal fees. Loser pays needs to be the law of the land. The lawyers who are encouraging these greedy azzholes should be disbarred also.
She needs to be hit again.
However, such greed and stupidity has an effect on other homeowners' costs.
I was smacked in the back of the head by a little league softball that got away. I was looking the wrong way when the girls were warming up. If you knew this team, I shouldn’t have turned my back! It happens. I was happy the girl was nice enough to say she was sorry, it was an accident. My husband, after making sure I was OK and then laughing, confirmed there was no aiming at my head!
Also, at some Little League games where the fencing doesn’t extend past third or whatever, you’ve got those idiot parents that put lawn chairs or whatever practically down the third base line and are shocked if they get
hit. Or the ones that park their car directly behind the backstop and can’t imagine why they have a ball size dent on the hood!
At one Little League game a batter hit a high foul ball that went over the back stop and hit a new Beamer. The father of the batter was involved in a fist fight when the owner of the BMW accused the kid of hitting the car on purpose. As if a 10 year old kid had that kind of bat control.

Stupid - the father of the batter should have told the Beemer owner to call the police. After all, deliberately hitting a baseball into a windshield is clearly vandalism.
Before you get hot under the collar, this is probably the only way to get to the Little League insurance policy. They have to name the kid, who pleads in the league and tenders defense to the insurance carrier. They can’t just directly sue the Little League insurance company without bringing in both the league and the perpetrator of the alleged wrongdoing. If she has been seriously injured and there is insurance to cover such injuries, then it is just to let her get to it. It is unfortunate the kid has to be involved but that is sometimes the way the law works.
If they wanted to go after the league (if there even is one in this case) and its coverage then they would just sue the league. The kid has a strong "assumption of risk" defense in this case in any event.

Another claim in the suit seeks to prove that Migliaccio was involved in “inappropriate physical and/or sporting activity” near Lloyd when she was struck.
The kid was in a fenced in bullpen on a baseball field playing freakin’ baseball! How in the hell can she claim he was involved in inappropriate physical and or sporting activity? Last I checked you play baseball on a baseball field. What does this ignorant woman and her lawyers think would be appropriate physical and or sporting activity on said baseball field? This couple sees dollar signs and are looking for an easy payday. People like this have ruined our great republic.
Next time, the kid will throw harder...
Hum, NJ eh. Wonder if someone gets the word that if they win the case, they will never live to see a dime of it.
We loved going to our sons baseball games in high school. The field has roads about 30 feet from each foul line. The locals knew enough to time the pitches when driving by, but every once in a while a foul ball would nail a car. Made the game even more entertaining...
