Court upholds EPA's greenhouse gas rules

WASHINGTON (Reuters) - A U.S. appeals court on Tuesday upheld the first-ever U.S. proposed rules governing heat-trapping greenhouse gases, clearing a path for sweeping regulations affecting vehicles, coal-burning power plants and other industrial facilities.

Handing a setback to industry and a victory to the Obama administration, the U.S. Court of Appeals for the District of Columbia unanimously ruled the Environmental Protection Agency's finding that carbon dioxide is a public danger and the decision to set limits for emissions from cars and light trucks were "neither arbitrary nor capricious."

The ruling, which addresses four separate lawsuits, upholds the underpinnings of the Obama administration's push to regulate carbon dioxide emissions, and is a rebuke to a major push by heavy industries including electric utilities, coal miners and states like Texas to block the EPA's path.

In the 82-page ruling, the three-judge panel also found that the EPA's interpretation of the Clean Air Act to regulate carbon dioxide regulations is "unambiguously correct."

The court also said it lacked jurisdiction to review the timing and scope of greenhouse gas rules that affect stationary sources like new coal-burning power plants and other large industrial sources.

EPA Administrator Lisa Jackson said the court found the agency "followed both the science and the law in taking common-sense, reasonable actions to address the very real threat of climate change by limiting greenhouse gas pollution from the largest sources."

Now THAT is flagrant info and indoctrination at it’s worst. I have been known back when my kids were in high school, to have a little chat with some teachers / guidance counselors about certain things my kids told me were going on in school.

I hope you marched into that school and demanded that teacher be FIRED. Oh wait....... teachers union moroooons. What was I thinking? I’d sit outside on the sidewalk with a sandwich board sign announcing the teacher’s stupidity to the public, or head to the school board meeting and ask for teacher’s removal and why. IF we don’t start pushing for the truth, we’ll never change anything. Sick of things like “Barack Hussein Obama... mmm...mmmmm...mmmm.”

Actually, it's well known that the EPA didn't follow either the science or the law. They piggy-backed on IPCC dreck and, when called on it by an EPA employee, told him to shut up because they had already decided what they were going to do. They violated the law because the Clean Air Act specifically does not pertain to CO2 and the arbitrary changes to limits triggering enforcement are not part of the law.

Meanwhile, Western/Rocky Mountain states continue to burn up. Makes the P in EPA a pissant.

This includesa fire coming toward the USAF academy—and its un-chapel. Someone is not pleased, and it’s not Mother Nature.

It appears that the law is what they it is. Unless, the GOP can get a bill through Congress and signed by a future President that limits or abolishes the EPA, the EPA can drive the US into the ditch and perpetual dependency through scarce energy, water and rapidly increasing prices. Maybe the Supreme Court will save the day, but when and I wouldn't count on it.

Exactly. We the People have allowed Congress to unconstitutionally assign its law making powers to unelected bureaucrats. It is a breathtaking assault on the basis of our political society, government by representatives of the people.

All administrative rule making without consent of Congress constitutes tyranny.
