Is the SCOTUS secretly guaranteed to have personal choice of health care and doctors and not for us serfs?

I just donated to the Romney campaign,

How exactly do you think that electing Romney is going to change Obamacare? You do know that a form of Obamacare was originally authored by Romney, don't you?

Anyone who has health care with an employer just lost it today. Your employer will pay the fine and you will be dumped into the health care pool. Your salary will go up little to none, but your taxes will go up big time to pay for all the deadbeats. The hard working poeple just lost big time! I just hope the unions also are subject to be dumped in the pool with the rest of us!

Color me shocked and pleasantly surprised.

Can’t wait to see Romney argue against ACA now, since it was based on the Mass law. His only fig leaf was the constitutionality. Now that that’s been striped away, he’ll look like John Kerry; he was for it before he was against it!

I hope something is planned for mid Sept. I’m on vacation, and would love to be part of the largest TEA movement to decend on DC. Bring the fire to the beasts den.

Public demonstrations are one thing but the real action from this point on is identifying who will vote for the GOP and getting those votes cast. This is a turnout election and we need to get every single freedom-loving American to cast a ballot. GET OUT THE VOTE! That is the name of the game for the next four months!

Congress can now apparently pass taxes while never having to admit they are taxes but the courts will uphold them anyway. A real Pandora’s Box was opened here.

Like most Tea Partiers, I have not and will not send money, make calls, post signs for Romney.

If however Romney is smart and wants to win, he will tap into the outrage that this will bring and make this at least his second campaign issue.

I think how they slipped around that is ... the mandate is not a tax, but the PENALTY if you don’t follow the mandate is a tax.

Extremely shaky reasoning IMO. If you follow this logic, then legal penalties of any sort are a ‘tax’. So taxes are penalties ... penalties for making a certain amount of money.

Yes, it shows Obama lied, and not only implemented the largest tax increase in history but also one that by design soaks people with incomes substantially below his promised $200,000 income floor.

This ruling also clearly indicates that the court, with near unanimity, sees limitations on the application of the Commerce Clause. This opens the door to a lot of other constitutional challenges.

Finally, I’d expect a new challenge based on the 14th Amendment’s Equal Protections clause, since the Obama Healthcare Tax must be applied in a decidedly disperate manner.

OBAMA’S HEALTH-CARE OVERHAUL UPHELD BY U.S. SUPREME COURT

5-4 decisions, with Roberts joining the court’s liberals.

Court says federal government can’t threaten to withhold money from states that don’t fully comply on Medicaid extension

CHIEF JUSTICE ROBERTS SAYS MANDATE IS NOT A VALID EXERCISE OF CONGRESS’ POWER UNDER COMMERCE CLAUSE AND NECESSARY AND PROPER CLAUSE

HEALTH LAW’S MEDICAID EXPANSION LIMITED BY U.S. SUPREME COURT -RTRS

ROBERTS, JOINED BY TWO JUSTICES, SAYS MEDICAID EXPANSION VIOLATES CONSTITUTION -RTRS

FOUR JUSTICES DISSENT, SAYING THE PATIENT PROTECTION AND AFFORDABLE CARE ACT GOES BEYOND -RTRSCONGRESSIONAL POWERS UNDER CONSTITUTION -RTRS

ScotusBlog conclusion: So the mandate is constitutional

The bottom line: the entire ACA is upheld, with the exception that the federal government’s power to terminate states’ Medicaid funds is narrowly read

The ACA is upheld as a tax, not a penalty

They didn't write new law. They ruled based on the government's position once they got into court, that the mandate was a tax and therefore within their power. Obama (and all the Dems) has insisted that it was NOT a tax b/c they knew we could hang that around their heads but when it got into court, their lawyers argued that it was, in fact, a tax. Greta Van Susteren was in court in FL for one of the appeals court cases and heard them argue it was a tax.
So- bottom line- the mandate is a “penalty” that can be levied as a tax but is not constitutional under the commerce clause.

If it is a tax, than the court cannot make a ruling on the Constitutionality of the tax (because of the Anti-Injunction Act) until the tax is actually imposed in 2014.

Since Obamacare is now considered a tax, and if it remains on the books until 2014, I would presume that the issue of a mandated purchase can be re-addressed once someone actually has to pay out any money (as a tax) to forego insurance.

It will be harder to unravel this mess by then, but the court challenges are not over.

Justice Roberts - the new boogieman for the Tea Party. Haha, I can see the signs now.

There’s more to this story (IMO) on why Roberts is voting the way he is........wonder if we’ll ever know what it is.

Meanwhile, if we want this bill repealed, we know what we have to do this November (and leading up to it).

Like all FReepers, I'm dissappointd and disgusted. This Supreme Court ruling opens the door to virtually unlimited power of congress to mandate citizens buy whatever any congress deems necessary. We know this new power will be abused and is the beginning of the end of our freedom. However, at this point, I refuse to succumb to rank cynicism and start loudly declaring that 'America is over'...but I'm getting close.

I also believe that this will doom Obamas re-election in November but I'm hardly sanguine about a 'President Romney' and a Republican congress repealing the monstrosity that is 'Obamacare'. However, I'll still vote Republican and hope for the best while, realistically, expecting much less.

As for John Roberts, I refuse to hate another person but right now, I sure do dislike the man and think he's sold out America with his deciding vote that upheld Obamacare. Shame on him.

Yeah, elections do have consequences. Did you vote for Bush? I did. Look what it got us. It’s like this, Bush, a REPUBLICAN, nominated Roberts.

I’m not real sure what this whole decision means in the long run since IANAL, but I’m not real confident. If there are openings in the decision that allow Congress to gut it or not. So, although I’m extremely disappointed in SCOTUS for not just stomping this into oblivion and throwing into the ashpile of history, I’m going through a gut check, I’m not giving up.

0bama and the rats played public opinion like a fiddle. Acting all pissed off and indignant, “threatening” the SCOTUS, etc., etc. Kabuki theatre. The joke was on us. The sadistic bastards knew all along what they were doing. Messing with our minds that we were going to “win” this one. And now look at us.

Those socialists in Washington D.C. and Crawford TX are laughing their asses off at us right now. Probably toasting our misery.

Romney, a REPUBLICAN (not a conservative) is a proponent of exactly this type of legislation, even secured its passage in MA.

0bama claims, and there is a lot of proof to support his claim, that this whole $hit sandwich was modeled after Romney’s version.

What, exactly do you propose as an alternative? Do you honestly think Romney, if he wins, is going to promote the repeal of this abomination to freedom?

Screw the presidency, those 2 pieces of garbage running for president are mirror images of each other from an ideological perspective.

The Congress is where the real power lies, take it back from those bastards and we can get real CONSERVATIVES working to get this thing repealed.

"Kagan should never have voted.'

If Kagan had recused herself, the vote would have been 4-4 which means the law would have been upheld. Recusal still should have applied on principle.

The handwriting was on the wall when the Arizona immigration case decision came down. The ACA law will never be repealed, it is a stepping stone to single payor. Follow the money, always follow the money.
