Questions loom over Obamacare taxes
Roger Hedgecock ^ | Jun 28, 2012

On the eve of the Supreme Court's decision on Obamacare, taxpayers are reminded that the President's healthcare law is one of the largest tax increases in American history.

Obamacare contains 20 new or higher taxes on American families and small businesses. On Thursday, Americans for Tax Reform will do a full analysis of the tax implications of the Court's decision.

Arranged by their respective effective dates, below is the total list of all $500 billion-plus in tax hikes (over the next ten years) in Obamacare, where to find them in the bill, and how much your taxes are scheduled to go up as of today:

Taxes that took effect in 2010:

1. Excise Tax on Charitable Hospitals (Min$/immediate): $50,000 per hospital if they fail to meet new "community health assessment needs," "financial assistance," and "billing and collection" rules set by HHS. Bill: PPACA; Page: 1,961-1,971

2. Codification of the "economic substance doctrine" (Tax hike of $4.5 billion). This provision allows the IRS to disallow completely-legal tax deductions and other legal tax-minimizing plans just because the IRS deems that the action lacks "substance" and is merely intended to reduce taxes owed. Bill: Reconciliation Act; Page: 108-113

3. "Black liquor" tax hike (Tax hike of $23.6 billion). This is a tax increase on a type of bio-fuel. Bill: Reconciliation Act; Page: 105

4. Tax on Innovator Drug Companies ($22.2 bil/Jan 2010): $2.3 billion annual tax on the industry imposed relative to share of sales made that year. Bill: PPACA; Page: 1,971-1,980

5. Blue Cross/Blue Shield Tax Hike ($0.4 bil/Jan 2010): The special tax deduction in current law for Blue Cross/Blue Shield companies would only be allowed if 85 percent or more of premium revenues are spent on clinical services. Bill: PPACA; Page: 2,004

I think SCOTUS just told us an election is coming up, and that it’s up to us if we want freedom, or slavery.

With my stomach churning as I awaited this decision, I looked forward to the beginning of the end of this nightmare.

Now with a sick feeling I still reel with disbelief -- what happens to the mandate to health care providers, etc. in regard to abortion and contraception -- I can't even think straight, I know that there are other suits pending on this issue itself (RELIGIOUS FREEDOM BEING ABRIDGED).

I did not hear or read the full arguments presented at the "hearing" of this case, but I do know that CONGRESS and the President avowed that this was NOT a TAX.

Why and how could the attorneys representing OBAMACARE LIE ABOUT THIS FACT ... and there be no repercussions?

That is my huge question -- is an attorney privileged to be a liar in court?????

A burning question for anyone.

The Supreme Court has allowed Obamacare's individual mandate as a TAX,

Talk about a shot in the arm for the TEA Party!

That is where the focus needs to be.

A TEA Party Fourth of July.

SC found it to be a tax.

OK...

He rewrote existing law - He did not even consider if it was Constitutional

HELP!

Today is a victory for some, a defeat for others. Impossible to tell which is which without a program, but...Who actually wrote the "Affordable" Health Care Act?

I have been searching in vain. At one point I actually knew what (Soros-funded) group wrote it but have been unable to find the answer.
Obviously, if members of Congress never read the Bill, they could not have written it.

So who did? Who presented the "fully written" abomination fully grown?

Any answers would be really appreciated.

Something can’t be a tax and at the same time not be a tax. It is or it isn’t. If it isn’t a tax then it is struck down. If it is a tax then it needs to go BACK and be passed in the Senate as a tax. It was ONLY by saying that it was NOT a tax that it was able to be passed. So call it back to be passed AS A TAX then.

Oh, by the waay, Google is no help whatsoever; it seems to have scrubbed every reference to who actually wrote the damned thing. I’m still looking.

Incorrect. They just affirmed that we already are slaves, but at least we still have some small choice in which taskmaster to suffer under.

How about this idea. Use the old commie subversive trick of overloading the system by using every g’mint fund available.
Fpr instance, sign up for welfare.
Even if you do not qualify.
Imagine tens of millions of request a day!
The idea is to overload the system anyway possible.

No capitation, or other direct, Tax shall be laid, unless in Proportion to the Census or Enumeration herein before directed to be taken.

The Sixteenth Amendment modifies the above text saying:

The Congress shall have power to lay and collect taxes on incomes, from whatever source derived, without apportionment among the several States, and without regard to any census or enumeration.

Isn't this healthcare Mandate an unconstitutional Direct tax under Article 1 Sec. 9 of the US Constitution? The Sixteenth amendment modifies this clause and removes the restriction against direct taxes, but appears to only do it for taxes based on income. Thus the prohibition on direct taxes does would seem to apply against direct taxes which are not based upon income. Even if the, mandate was a tax, which it is not even if the delusion Roberts says it is, it is still an unconstitutional tax since it is a direct tax not based upon the income of the taxpayer.

Today is a victory for some, a defeat for others.

No, today is a defeat for ALL Americans, but the other half of them haven't realized it yet. The Supreme Court essentially renounced any kind of limitation on federal power via this decision. The government can force you to buy any product they want now because of the whim of lobbyists in Congress or the Executive Branch.

We have lost de facto our economic independence, and once that freedom is lost the others will soon follow. This decision of the Supreme Court is an act of TREASON. Roberts, and all of his accomplices MUST be impeached for high crimes and abuse of power.

At the time Daschle was up for consideration for HHS there was an article that explained his importance to Obama for that position due his involvement in creating the healthcare bill. That Daschle knew every intricate detail about that bill.

Apparently Daschle’s personal finances were more important to him than the position, and he stepped down from consideration to protect his nestegg.

I don’t have any links, but there should be something out there if you do a search for Tom Daschle. I know Obama put much faith in him.
