WASHINGTON (AP) - A top adviser says Republican presidential candidate Mitt Romney doesn't see the health care mandate as a tax but as a penalty or a fee or even a fine.
That's a different view from Republicans who are condemning the individual mandate in President Barack Obama's health care law as a tax instead of a penalty, as Obama prefers to call it.

But Romney believes in the penalty, he believes in an Individual Mandate and he will replace Obamacare with something that has an Individual Mandate.
And yet we have so called conservatives here on FreeRepublic backing Romney on his “Repeal and Replace” nonsense when HE HAS NEVER GONE BACK ON HIS INDIVIDUAL MANDATE.

It’s a penalty if you are referring to the view of the conservatives on the Supreme Court. It’s a tax if you are referring to the ruling of the Supreme Court (and therefore the law).
Romney can call it a donut if he likes. What counts is his commitment to repeal Obamacare if he becomes President.

As much as I detested the SCOTUS decision I will for now stand with his decision due mostly because of the intense irritation it is causing Obama.
Romney needs to get something straight, the people can if pushed be motivated to write in someone else, even at the obvious risk of handing the election to Obama.
At least Obama is universally hated, he can never get his supporters back in line, he will never have his hypnotized idolizers at his feet anymore, if elected Obama won’t last 6 months I project, he will be impeached.
I would rather take a chance of losing to Obama knowing actions are in effect to remove him quickly that vote or support Romney.

That John Roberts does not see that is an indictment of how far away from the constitution he has moved.
Yes it’s a mandate which makes it unconstitutional BUT now that Obama lawyers were saying it was a tax in oral arguments and Roberts said it was a tax and it being passed in the SC in Obama’s favor - Romney could have hanged Obama by the skin by talking about the largest middle class tax hike in history which makes Obama a liar (we had Freepers celebrating that ObamaCare being called a tax would guareentee Romney the election) - Romney, through his aide has completely taking it OFF the table in trying to defend RomneyCare and the average voter doesn’t care if both sides are arguing over the semantics of Mandate here and Tax there and who said what but they clearly understand what a massive tax hike is

McConnell said today that the odds of Obamcare being repeal is not in their favor - I always question if the Republican Party in D.C. was really serious about repealing it. Yes, they have said so but we have seen them back off numerous of times and still expect conservatives to fall in line eventually
Under Obamacare the 15000 new IRS agents do a lot more than collect the penalty.
And the payment that you have to make only if you fail to comply with a government mandate is in fact a penalty. Prior to Obamacare, there was a long line of cases defining “Tax” and a selective penalty only applied to those who do not comply doesn’t fit the definition.
However, whether or not it is a tax or a penalty, the process by which it can transform a federal government dictate to participate in interstate commerce into something constitutional is still a mystery.

I traveled across the city of Hartford Ct to visit relatives by foot, bike and sometimes bus.Today you need a convoy with heavy firepower.

Romney got stuck with this position when he said he agreed with the dissenters (Scalia, Alito, Kennedy and Thomas). Their dissenting opinion ruled that the mandate was a penalty and could not be a tax.

Romney is right, it is a penalty. It is not a tax. I’m sorry to see Allen West and scores of other Conservatives calling it a tax just to score political points for the coming election. I understand their motivation, but the fact of the matter is that if I buy a kitten and call it a cow, it doesn’t make it bovine.
The penalty in Obamacare is certainly not a tax. Roberts just made that up, knowing there is no higher court in the land to which we can appeal the ruling. The Chief Justice of the nations highest court can just pull stuff out of his ass, knowing that he gets the last word. If he says the sky is blue instead of purple, then the color we all see as blue is sudden labelled purple.

The odds of Obamacare repeal is not in our favor. McConnell sucks but he is right. Unless or until both the White House and Senate become GOP controlled, then there is no chance of repeal. With Obama in the WH and with Reed running the Senate, McConnell is right to say there is scant chance of repeal. Now after Jan. 1, 2013 when we have the WH and Senate and keep the House, then there will be repeal.
You can’t understand that the republicans are pandering for votes and will tell us all to stick it after they’re elected?
McConnell isn’t a conservative first of all, he is a Republican - a weak establishment one at the least and the way he was talking wasn’t about counting chickens - any conservative who follow politics should automatically side on it NOT being repeal with these feckless bunch of Republican leaders we have to seem to tough talk but weasel out in the end
What are the odds you offer on electing enough Republicans to have a total of 60 Republican US Senators?
Unless that number is very high, then I’m voting Romney and hunkering down.
And that’s assuming none of the 60 would be RINOs. I’d think the resulting odds would be very very long indeed.
