Probably no fleeing felon statute in NY. The federal standard in this case albeit he was enforcing a state law, is to shoot only when in jeopardy or someone else is in jeopardy. Seemingly on the second part he was fully covered.
Anyway, it is a sad event when one trying to do the right thing gets killed. Since there was a homocide during the commission of a felony, the perp can do a threesome for life in the showers at Attica now given his new found oriface.
