A treaty governing the high seas is all but dead in the Senate as two Republican senators announced their opposition Monday, giving conservative foes the necessary votes to scuttle the pact.
Sens. Rob Portman of Ohio and Kelly Ayotte of New Hampshire... said they had serious concerns about the breadth and ambiguity of the Law of the Sea treaty and would oppose it if called up for a vote.

In the past the Constitutional requirements have been very clear: foreign "treaties" needed ratification to be enforced, while foreign "agreements" and "compacts" did not. But the Roberts Obamacare ruling has made things less certain.
A new precedent was set when what in Obamacare was called a "penalty" both by the Congress that wrote & passed it and the President who signed it, was deemed a "tax" by SCOTUS Chief Justice Roberts - solely to make what was unconstitutional miraculoulsy constitutional.
So too, it is easy to see what was signed by the President and NOT ratified by the Senate as a "treaty" to, by Roberts' logic, not be a "treaty" (but an "agreement"/"compact") - soley to make an unconstitutional Obama enforcement of LOST again miraculously constitutional.
After November, if Obama is NOT voted out, even if bullying surviving GOP Senators into ratifying does not work, he will enforce LOST without Senate ratification. Thank you John Roberts!
Because after November, Chairman Kerry will be Mr. Ranking Member and former presidential loser and won’t get to be secretary of state.
Kerry is waiting to see how it would affect taxes on his yacht and whether he might have to register it in yet another state.

Please forgive, but as a Nam Vet who hates Kerry with every fiber of my being and will NEVER forgive him for all the pain, suffering and decades long shame he caused so many of us Vets, just can't help myself.
Don’t forget, the U.S. Constitution says: “provided two thirds of the Senators present concur;”
Watch for them to attempt ratification in an off hour when most Senators are not present.
In any event, it will not stop the Administration from implementing it. That is what Clinton and Obama did with the Convention on Biological Diversity. It is why all our public lands are managed for biodiversity, ecosystem health etc. vs “multiple use and sustained yield” which is actually the law.
