Judge Dismisses Major Lawsuit Against Obama HHS Mandate

A federal judge has dismissed the lawsuit filed by attorneys general of several states against the Obama HHS mandate that requires to religious employers to pay for or refer women for abortion-causing drugs and birth control in violation of their religious liberties.

U.S. District Judge Warren Urbom of Lincoln, Nebraska dismissed the case the state attorney general there filed with several other colleagues from across the nation. he said the states did not have standing in court to bring the lawsuit against the Obamacare HHS mandate.

Nebraska Attorney General Jon Bruning’s office brought the lawsuit along with attorneys general of Florida, Michigan, Ohio, Oklahoma, South Carolina and Texas. Catholic Social Services, Pius X High School and the Catholic Mutual Relief Society of America joined the Nebraska case against the mandate.

A Lincoln Journal Star report on the decision provided more details about the judge’s reason for dismissing the legal challenge:

Urbom sided with the U.S. Justice Department, which argued that the plaintiffs did not show that they faced the immediate threat of having to offer the coverage, because the federal government delayed enforcement of the rule until August 2013. That so-called “safe harbor” provision is to allow accommodations to be worked out for some religious groups.

The Justice Department also said the states lacked the legal grounds to sue over the provision because they don’t enjoy First Amendment protections.

What about Obama’s 1,500 ILLEGAL waivers to his union cronies and campaign donors? How come the church can’t get a waiver? What about THAT, Judge Urbom? WHERE THE HELL IS THE LAWSUIT OVER OBAMA’S WAIVERS? HOW CAN A PRESIDENT UNILATERALLY ORDER SOME AMERICANS TO PAY A TAX AND OTHERS NOT?

Lovely! When the States have no standing against the Federal Government, who does?

We are fast becoming a lawless nation due to the stupid rulings (read political) by both State and Federal Courts.

We will soon learn whether large organized religions in the USA have beliefs they will stand behind, or are just businesses using religion as a tax dodge.

Romney should announce loudly and clearly that Catholic institutions will not be forced to go against their teachings if he is elected. He should say that while he is standing next to Cardinal Dolan.

States are people. First amendment applies. In fact states can do religious things fedgov cannot.

Close them or seize them in some form of nationalization and maintain the staff that will stay, making it clear that doctors who quit will have severe problems in practicing medicine anywhere else.

Senior U.S. District Judge Warren Urbom was expected to sign papers this week for admission into Lancaster County pre-trial diversion services.

Lincoln police ticketed Urbom for misdemeanor motor vehicle homicide in connection with the traffic death Sept. 8 of Fred McEntarffer, 74, of Lincoln.

McEntarffer was westbound on a motorcycle on L Street at about 11 a.m. when a car driven by Urbom collided with the bike near 13th Street. According to police, Urbom, 80, was attempting to turn left onto 13th Street from a middle lane of L Street at the time of the collision.

The Lancaster County Attorney’s Office said Monday it would file the misdemeanor charge against Urbom next week in Lancaster County Court. Once the charge is filed, and Urbom has been admitted into the pre-trial program, a judge would dismiss the case.

Urbom would be in the pre-trial diversion program for one year. The program typically includes 100 hours of volunteer service at a non-profit agency and the surrender of the participant’s driver’s license for 60 days.

The County Attorney’s Office can refile the original charges against participants who fail to complete the program.
