When it comes to Presidential elections, the Congressional and gubernatorial elections are irrelevant and all the case laws associated with them.

Article II as modified by the 12th Amendment is not justicable. It sets out how the Prez is elected, and it is via the State legislatures and Congress.

Holder can attempt to muck things up in the courts, but the States determine via statute how Presidential electors are appointed.
