Alleged DWI Claims Tiny Life (Illegal alien with NM drivers license)

They are powerful images. One is of an anguished young mother lying in a hospital bed holding her lifeless baby. The other is of the father, saying a prayer over the tiny boy just before handing him over to the Office of the Medical Examiner.

It was the only time Zach and Aileen Smith held their son, whom they named Dimitri after Aileen’s grandfather.

The child was born by Caesarean section in a Santa Fe hospital in an effort to save him, just hours after the Smiths were involved in a crash with an alleged drunk driver on June 10 on Interstate 25 in San Miguel County. Aileen was seven months pregnant at the time.

Ramon Hernandez, 43, of Las Vegas — who has at least four prior DWI convictions — appeared in court on Tuesday on charges of multiple offenses.

He was originally charged with felony DWI and causing injury to a pregnant woman. The latter charge was amended a few days later to vehicular homicide.

Aileen finds it hard to understand how — if Hernandez has immigration issues — he “can be in this country for that long … and have so many offenses and still be allowed in the country,” she said. “It’s a terrible failure of the system.”

This story will first bring a tear to your eyes then make you angry, very angry.

Under the corrupt Richardson administration which signed a law giving licenses to illegals, Hernandez got a drivers license but it was not revoked after four previous DWI's nor was he scheduled for deportation.

and this illegal ( and yes he is) was not allegedly drunk he was toasted on his ass. And no doubt his mug shot shows that. Lord how I wish we would seal our borders

How about when things like this happen we list Congress, Governors and state representatives as unindicted co-conspirators for failure to enforce existing laws.

The reason this keeps happening is that we don’t go and confront the politicians on the issue. We need to not only write our Reps, but we need to get in their face on these issues. Make their lives miserable.

This is horrendous, Sad, heartbreaking. Look at the face of the mother and the father... holding their little sweet baby. When is enough enough in this country???? How come someone can get that many counts against him and still drive and...be illegal? Wghat the hell does that mean?

When did this country lean towards protecting and defending everyone in this country who is illegal or corrupt? Whaat happened to protecting the citizens of this great country and keeping us safe?

God be with these people... they lost their child due to someone else who is illegal, has charges against him previously and running loose among everyone else.

In New Mexico, DWI perps come in all varieties - Anglo, Hispanic, Native American and illegals. Illegals are the only group that as a whole should not be given driver’s licenses. The others have to be dealt with harshly if convicted of a second DWI. However, in many areas of the state driving under the influence is winked at, especially in the northern area where extended families include members in law enforcement and the legal system.

The anguished picture of the mother is "above the fold" on the front page of this morning's ABQ Journal. It will be seen by tens of thousands in convenience store racks, in vending machines, on the front porch of subscribers, etc. Maybe, just maybe, it will help focus attempts by Governor Martinez to once again repeal licenses for illegals in the next legislative session in January.

I agree Dave, but Richardson is long gone. The entrenched Liberals in Santa Fe have fought of numerous attempts by Gov Martinez and Republicans to repeal this law. Ever time repeal is brought up the haul out the trusty ole “RACE CARD”.

We need a real Tea Party uprising in Santa Fe, sadly I do not see that happening as the northern half of state is pretty much dominated by the Democrat Party.

What a heart wrenching story to read. I can’t even express how very terrible I feel for this couple and their extended family. Being the only grandchild on both sides and the only child born since this baby’s mother’s birth on her side, this death has to have affected a large number of family on both sides. May God watch over them and help them in their grief.

I can only hope that their grief and vow to follow this case through to the end will compel them to work to change Legislator’s minds on the driver’s license issue. Although whether or not he had a license probably wouldn’t have stopped him from driving, it’s a start. I hope they can energize someone to do something about our DWI problem here.
