Zimmerman lawyer appeals judge’s refusal to step down(barf alert)

George Zimmerman’s defense attorney asked a higher court Monday to reconsider the refusal of the judge in the case to step down.

Mark O’Mara filed a motion last month asking Seminole County Circuit Judge Kenneth R. Lester to recuse himself. Citing the judge’s scathing order setting bond at $1 million — in which the judge accused Zimmerman of getting read to skip town with a cache of donations — the defense said it had lost faith in the judge’s objectivity.

Judge Lester flatly rejected the request to step down, saying it had no legal merit.

Now O’Mara wants the Fifth District Court of Appeal to reconsider Lester’s ruling. He filed a lengthy motion at the Daytona Beach courthouse Monday afternoon.

The issue is critical for the defense. Under Florida’s controversial “Stand Your Ground” law, a judge decides on whether a defendant should be granted immunity based on a claim of self defense. Many legal experts believe that Zimmerman is on weak footing with Lester, who offered Zimmerman special perks at the start of the case, and then accused him of disrespecting the criminal justice system.

The local TrashBloid, the Orlando Sentinel, is even worse in their coverage. They have pretty much lynched George Zimmerman already

Frances Robles pushes the Black Racist agenda for the Miami Herald, but that paper has actually done some stories helpful to Zimmerman, esp reporting about Trayvon Martin’s school suspensions

I am betting Robles does not reside in Little Havana, Hialeah, or other Cuban-Amer neighborhoods in the area....for I am sure she will get a talking to about Black Racism and how Cuban-Amers. in the area have been victimized by it for years

This is not merely normal, but required. Zimmerman's attorney would have his legal malpractice insurance company on his rear if he didn't do it. This is called the defensive practice of law.

When a businessman does something that doesn't seem to make sense, it's probably about taxes. When a politician does or says something that doesn't seem to make sense, it's probably about fund-raising. When a doctor or lawyer says or does something that doesn't seem to make sense, it's probably about malpractice premiums.

Here it makes sense, but that's beside the point. Zimmerman's lawyer has to do it anyway.

I'll admit that I haven't been following this case that closely in recent weeks, but it was my understanding that Zimmerman's defense was not going to be asking for a "Stand Your Ground" hearing. They say that because Zimmerman was attacked he had no duty to retreat. I guess the thinking is that "Stand Your Ground" only applies to situations where there has not yet been a physical attack -- only the threat of one. Apologize if my understanding is a little off.
