Obama Administration may Hurt Immigrants Because it has Bypassed Legislative Process

On June 15, a Department of Homeland Security memorandum by Secretary of Homeland Security Janet Napolitano announced President Obama’s immigration policy directive, Deferred Action for Childhood Arrivals, which goes into effect today.

Undocumented immigrant advocacy groups, immigration lawyers, and illegal/undocumented immigrants have been feverishly preparing since the announcement. Most of these efforts concentrated on educating the public about Deferred Action, and beginning the process of collecting required documentation.

At the time, these stakeholders were preparing for an application they had not yet seen, an unknown application submission deadline, potentially overwhelming numbers of applicants, and other unknown variables that may yet come as a shocking surprise with the actual release of the application.

I do not understand why I haven’t heard of any party filing a federal lawsuit at least looking for an injunction against this unconstitutional order. Is there any?

Since the federal government has handled the Social Security program that’s been in effect 70+ years so well, we know what we can expect from this sloppy amnesty decree, rushed through to buy illegal alien votes. Prediction: There will be many career criminals with Obama papers who will have two years to prey on U.S. citizens unmolested.

Exactly!! And if the next President isn’t obmaa, this executive order could be rescinded, and these illegals have exposed themselves.

I really hope someone points that out to them.

Keep in mind that the original requirements for the reprieve were that the provisionally amnestied “children” had to: be under the age of 31 and entered the country before their 16th birthday and currently in school, graduated from high school or have a GED or honorably discharged from the US military; no convictions of felony or three misdemeanors; and don’t pose a threat to national or public security.

The main reason this country—in the past at least—has rejected a chief executive issuing (royal) edicts/diktats is that such things tend to be arbitrary and/or capricious. In other words, like something a king with unbridled powers would issue.

And here King Obama is already talking about bending his own requirements, that is, giving the DREAM dispensation that Congress—our, uh, legislature as you may recall—refused to provide.
He has mandated that this de facto amnesty be given to dropouts, young people who can’t speak English (didn’t sneak across our border before their 16th birthday) gang-bangers and drunks who kill Americans daily and “children” possibly into their late 30s and 40s.

In other words, its a stacked deck—stacked against Americans and for Democrats.

Here’s what Romney had to say about it when asked specifically on Face The Nation shortly after the program was announced whether he would repeal it.
“It would be overtaken by events, if you will, by virtue of my putting in place a long-term solution with legislation which creates law that relates to these individuals such that they know what their setting is going to be not just done for the term of a president but on a permanent basis,” Romney said.

If anyone can translate this into English, as Ross Perot once said: “I’m all ears.”
Sorry to say, this gobbledegook sounds better than what we’re seeing out of the WH.
If Mitt’s still confused in 4 years, he joins Jughead in retirement.
In the meantime, Romney and his people have to get their s*** wired on this issue.

Even legal immigrants I know who have obeyed the letter of the law describe the bureaucratic process as a pure fustercluck. This is going to be far worse.

IMHO, every Governor of every State needs to scream 'abuse of power' at the top of their lungs and flatly refuse to implement it until it comes down through the proper Constitutional channels.

Due to recent passage of laws in Arizona, Gov Brewer of Arizona is standing alone.....and she shouldn't be.

Federal immigration law enforcement agents are boldly challenging their bosses in the Administration. Today, they have put up a petition on their website that protests what they consider to be threats of punishment if they don’t follow orders to violate immigration laws passed by Congress.
The union’s website invites the public to sign the petition and stand behind these courageous immigration agents. Sign their petition. Then ask all your friends to sign it.

The petition is addressed to ICE Director John Morton.
He is the author of the infamous Morton Memo of a year ago that provided the framework for the Department of Homeland Security’s actions beginning today in accepting applications for the mini-DREAM amnesty.
The Morton Memo broadened the concept of prosecutorial discretion to the point that huge classes of illegal aliens could be exempted by the Administration from having to obey immigration laws.
But ICE agents are finding that the Administration’s new rules actually don’t give them much discretion at all.
The Administration’s supposed prosecutorial discretion is in fact the absolute loss of discretion by ICE agents to do anything except ignore the law.
The ICE union website states:
Reports are now emerging of ICE agents using their prosecutorial discretion, but then being punished if they determine an illegal alien should be put in deportation proceedings.
A veteran ICE agent recently arrested an illegal alien who had 10 traffic violations. The ICE agent determined, in his discretion, the alien did not fit within the outline of the Morton memo or the Executive DREAM Order and initiated deportation proceedings.
The agent’s supervisors overruled him and ordered him to release the illegal alien.
As a result of attempting to do his job, the agent in question is now facing a three-day suspension. If suspended now, this military veteran and eighteen year federal law enforcement officer will be fired and lose all retirement benefits earned if he attempts to exercise prosecutorial discretion again in the future.
Not surprisingly, a union would recognize the threat to all American workers if ICE agents don’t have the discretion to actually enforce immigration laws.
I was thrilled to see that the union for ICE agents has taken the lead today in pushing back.
Won’t you please do everything you can to spread the word about this petition through email, on websites and through Talk Radio?
