The death penalty is not mentioned in the US Constitution anywhere. It is not mentioned in any Amendment either. The Eighth Amendment prohibits any cruel and unusual punishment, but the US Supreme Court has ruled that the death penalty is not in and of itself cruel and unusual.
More to the point, you have avoided the question. Is it a bigger crime to convinct one innocent person than to let 10 guilty people go free and that protects individual liberty? Or do you favor a system of government and social norms as found in China or other totalitarian states where the the state is more important than the individual?
