Jacquetta Simmons takes the stand, (punched Walmart cashier)

For the first time in public, Jacquetta Simmons told her side of the story today, and in front of the one audience who's opinion of the events Dec. 24 at Walmart really matter: A jury of 12 Genesee County resident who tomorrow must decide whether a 26-year-old Simmons intentionally punched 70-year-old Grace Suozzi.

Simmons, now 27, said she had no idea she even hit Suozzi until hours later. She said she was horrified to learn she had injured Suozzi and it's been a painful realization ever since.

"I feel horrible about it," Simmons said during her only tearful moment on the stand. "I wasn't expecting somebody being -- how was I supposed to know she was standing right in front of me? I keep thinking 'how could I have hit this elderly lady and I don't remember that I hit her?'"

District Attorney Lawrence Friedman, however, judging by his cross examination, wasn't buying Simmon's contention that Suozzi was hit on accident.

While Simmons contends that somebody -- she doesn't know who -- grabbed her arm and, in her own words, she "aggressively" pulled away from the person, causing her to strike Suozzi, Friedman wanted to know how Simmons couldn't have seen Suozzi.

Through repeated questioning, Friedman got Simmons to admit that Suozzi was just a foot or so in front of her when she "punched" Suozzi.

In various ways, through various questions about events, Friedman got Simmons, whose background includes volunteer work in literacy training and child and elder care, to repeatedly admit to "punching" Suozzi.

Here is reporting on the trial testimony. Particularly note: the videos of the incident do not show a receipt checker between the express register and the exit doors.

I could buy that she was struck accidentally. It would be a hard sell, but I could buy it. It happens.

But "I don't remember"? Please. My kids come up with better lies on the spot, and she's had a long time to think about it.

Next, for the prosecution, Samual Hackenberg (an assistant manager) testified that he didn't arrive on scene until after Suozzi was hit.

After ensuring Suozzi was being cared for, he went outside to see what was gong on.

He testified that once outside, he said he heard Simmons say, "do you think I care about these dirty white people?"

Can you imagine if this had been a young white women who punched out an elderly black cashier and then said "do you think I care about these dirty black people?". It would be national news and the FBI, Homeland Security, and Eric Holder's Justice Department would all be investigating and she would facing life in prison on hate crimes charges.

So why isn't this considered a hate crime?

I know this is obscure, but it has baffled me since my son was at USC and after a year or so in LA started saying “on accident” instead of “by accident”. This is really the first time I have seen this grammatical error in print, although I ran into another person from LA who says it all the time. My son quit saying it after he was back on the east coast for awhile. Can anyone tell me the origin of this strange change of a prepositional phrase? Don’t be too unkind; I really want to know.

I think it comes from the phrase “on purpose”, as in “I hit her on purpose.” You wouldn’t say, “I hit her by purpose.”

I do agree with you. It’s wrong. “By accident”, then “on purpose.” Not “by purpose” or “on accident.”
