Appeal court: Lester is out (of the Zimmeman case)

Second-degree murder suspect George Zimmerman gets a new judge.

The Fifth District Court of Appeal in Daytona Beach on Wednesday ruled that Circuit Judge Kenneth Lester Jr. in Sanford went too far when, among other things, he described Zimmerman as a manipulator.

It was "admittedly a close call," wrote Judge C. Alan Lawson, but Lester's actions, taken in total, would cause a reasonable person to fear that he is biased.

The next step is for Circuit Judge Alan Dickey in Sanford to pick a new judge. It's expected to be Circuit Judge Debra S. Nelson, 58, another felony trial judge in Sanford who has a reputation for handing down tough sentences.

She's been a judge for 13 years, much of it on the criminal bench, although she was a civil litigation specialist in private practice.

Looks like there's a fair chance Zimmeman may get a fair trial after all. A bit less of a chance for a judicial lynching of an innocent man who legally, morally, and legitimately defended himself from a wannabe murderer.

No they are still trying to railroad him. They already know the name of the likely next judge in a system that’s supposed to be random selection.

Saw this on page 8 of our local newspaper in a small column.

Front page status for this travesty ( convict George) has obviously dwindled, and to me removing this judge is a good first step towards his getting a fair trial in spite of all the attempts to paint him in a negative light.

Well, well...

Who knows anything about the next judge?

That aside, the fact that Lester refused to step away from the trial likely displeased those who decided he now HAS to. On its face, the judge’s statements DID appear biased against Zimmerman, and an appearance of bias is not acceptable.

Good riddance.
