New law could bring fines for ignoring mandatory evacuations in North Carolina

A new law in North Carolina means you could face a fine and criminal charges if you ignore a mandatory evacuation order.

The law passed in this year’s General Assembly and goes into effect October 1st.

It makes it a class-two misdemeanor to not leave when ordered to do so. Those who stay could be fined up to $1,000 and be removed from their homes.

So, if you decide to stay and protect your home from looters, you’ll be dragged away and hit with weapons charges, too?

A similar program worked well for the Germans in Lodz. They got some pushback in Warsaw, but eventually implemented the program after dealing with the holdouts.

Not to worry though, the government has some very nice camps these families can relocate to in case of such an evacuation order. “Never mind the barbed wire, that’s just to keep out animals and such.”

This is probably in response to the hurricane last year that cut through Hatteras Island just north of Rodanthe, severing access to the island for months while an emergency bridge was built.

I’m wondering how the long time residents, decendants of generations of outer bankers are responding to this.

I grew up near Morehead City, NC. Years ago, when Isabel was bearing down on that area, I called my Dad and asked him what they were going to do. His statement was “I’m not going anywhere, I’m staying right here.”

My Dad’s side of the family has been living in that area since the 1720’s and Dad lived all of his life there except the 5 years he served in the Army during WWII.

If the government is saying it doesn’t have the resources to protect those who stay, fine, don’t drag them out and cause even more drama.

Have the persons staying behind sign a waiver that they understand due to whatever the emergency is, they should not expect any assistance because it will be already be allocated elsewhere or it is not feasible to have resources in the affected area during the emergency.

Some people will fight desperately if you try to take them out of their homes.

This NC legislation may be counter to the 4th Amendment.

Not elaborate enough. Under Roberts it would be, "if you don't leave, you'll pay a not leaving tax that will be colloquially known as a fine or penalty (though still actually a tax), after you don't show up for the hearing, you'll be dragged away.

your words summed it up pretty well, and they’ve told us this before, haven’t they? Rahm “pretty boy” Emmanuel said it, and I’m betting it’s Valerie Jarrett’s mantra...

Can understand “if you don’t leave, we won’t come get you.” But to FINE someone and FORCE them to leave does indeed sound like Hitler’s or Stalin’s actions.

Whoa...and wow. I’m SO concerned about our country’s future...

And that swath that was sound side flooding was man-made..the “birders” had the govt/ build levees to catch fresh water for migratory birds to use...the “cut” across HWY 12 was created due to the sound side ater being pushed into that area by the levees. I just drove over it again last weekend, plain as day, right where the levees end, the sound side water had nowhere else to go but through there.

Chief Justice would beg to disagree. A fine for inaction is really just a tax, well that is what the legislation meant to say....

In 1979 the Navy sent me to Norfolk, VA. I never left.

Our “official” evacuation route would take us on I-64 west (actually north-northwest) through the Hampton Roads Bridge Tunnel, a route that backs up for 10 miles every Sunday in the summer with tourists trying to get home. Plus, since the hurricanes historically come from the south, evacuating that was would just be running away in the path of the storm. Wherever you stop, the storm will come there. Logic would say to move perpendicular to the storm's path, to get out of it's way.

But like my Dad, I will prepare for the worst, and to quote him, “I ain't goin’ no damn where, I'm stayin’ right here.” With over 80 years of living in the #2 Atlantic coast target for hurricanes he knew what he was doing.

my dad’s family moved from VA into NC in 1732; still some family there; but i’m in NC beautiful mtns and NO ONE is going to tell me to evacuate. we survived the floods of hurricane Ivan. i can’t imagine leaving your home. i really feel for those on the coast
