Murderer’s surgery seems like cruel step

I’m very confused lately by the Eighth Amendment in the Bill of Rights.

My understanding has always been that it bans “cruel and unusual punishment.” Yet now there is a federal court decision saying that not castrating a convicted wife murderer so he can become what he considers to be a woman is an “unnecessary and wanton infliction of pain.”

In other words, not mutilating this killer constitutes cruel and unusual punishment.

The operation in question has several different names. Sexual reassignment surgery. Vaginoplasty.

Of course I’m talking about the case of Michelle Kosilek, formerly known as Robert. He’s been in prison since 1990, when he strangled his wife with wire and left her body in a mall parking lot. Her name was Cheryl McCaul. Mish Kosilek never mentions her, for obvious reasons.

There are conflicting stories about how much anguish Mish has suffered during the years in stir. Her court appearances started 12 years ago, so I guess she was OK with being a guy for a decade. But now, some of the news stories mention that she has attempted suicide twice. Yet in an interview with the Associated Press, Mish said that “at several points ... (I) was very close to committing suicide.”

So did you attempt suicide, Mish, or were you just very close?

In the AP interview, she said that she and “the sisters” (by which I think Mish means the others who are now queuing up for their surgeries) have decided that the outrage about the court decision “is bigotry related to gender identity disorder.”

No, Mish, it’s bigotry against murderers gaming the system. By the way, the word is that at least one of the “sisters” has killed not one, but two women. How’d you like to be one of the real “sisters” at MCI-Framingham if the Department of Correction eventually starts moving these people into the women’s prison?

The DOC declines to comment on where Mish and the sisters might be moved if there is a change in their ... status. Currently, Mish is incarcerated at MCI-Norfolk.

Another baffling piece of this story: The sex-change operation was being opposed by the liberal Democrat administration of Gov. Deval Patrick. And the judge who ordered Mish’s procedure is Mark Wolf, an appointee of then-President Ronald Reagan.

What precedents does this case set? How about if some jailbird decides he wants to commit suicide? He can claim he is suffering from livingophobia, and not giving him enough cyanide to off himself is ... cruel and unusual punishment.

How about drug addicts? They’re not allowed drugs in prison. Talk about cruel and unusual.

Here’s one more AP soundbite from Mish:

“To those who don’t understand gender identity disorder, I understand that there is a reluctance to even think about this in a serious vein because to the average person ... this must seem bizarre.”

You got that right, Mish.

The judge who thinks it's ok for this whackjob murderer to get this operation and the tax payers foot the bill should be thrown off the bench.

I’m not so sure I would blame the judge as much as the Patrick administration. It’s a terrible decision, but I doubt that the Patrick administration actually fought the case vigorously. I notice they made no announcement that they would appeal, and the Federal judge involved cited no higher court precedent. I suspect that the judge must act on evidence presented, and if one side argues vigorously and presents quack experts and the other side falls over, the quacks carry the day. Look at the Bellesides fraud debacle.

OK moonbats, no more Mr. Nice Guy.

I let it slide when some liberals in a Prius stole the Sean Bielat sign in my front yard in the predawn hours on Labor Day, leaving behind a JoJoJo Kennedy sign.

I just took the JoJoJo sign to the dump, got another Bielat sign and forgot about it.

But now you trust-funded, EBT card-carrying, Kool-Aid drinkers have gone too far.

I’d just gotten a new Scott Brown yard sign, which was planted next to the Bielat sign. Early Sunday morning, before dawn, I left to drive to Logan airport for a flight to North Carolina. Family business. When I landed in Raleigh, I got a call from my wife — the mailroom manager, as I fondly call her.

“Notice anything different in the front yard when you left?” she asked, and I immediately knew we had once again been the victims of a senseless street crime.

This time, they’d rubbed our noses in it. The moonbats not only kidnapped both Republican signs, but they replaced them with a Granny Warren sign AND two Barack Obama signs.

The Barack signs they left in my yard were white-on-blue, with Obama and Biden’s names. You don’t see these every day, not even in Brookline or Cambridge.

The mailroom manager was livid. She called the cops — the moonbat mob had been on a veritable crime wave that night, hitting at least three other houses in our neighborhood.

Then she called Scott Brown headquarters and ordered a 4-foot-by-8-foot mega sign. Then she put up a spotlight to illuminate it, not to mention any sticky-fingered new crew of diversity celebrators. And if any of you Occupy alumni do get lugged, please don’t try telling the cops that you thought there was a battery-charging station for your Volt in my driveway.

What I don’t understand is why the moonbats feel entitled to behave in such a boorish manner. Does the First Amendment only protect Democrat yard signs?

It’s the old double standard. They rip down my signs and defend it by saying dissent is the highest form of patriotism. It’s civil disobedience, speaking truth to power. But if I rip down their signs, it’s a hate crime.

Meanwhile, the mailroom manager called a friend of hers, one of the largest property owners in Boston. He agreed to let the Brown campaign put up the giant signs all over his various properties. Scott’s people moved fast. If you’re in Brighton or Brookline, you’ve probably already seen one or two.

As for the giant new sign in my yard, I’d like to say something to any moonbats itching to try to snatch it. In the words of a speaker at the recent Republican convention, “Go ahead, make my day.”

With a friend from Ohio yesterday driving around Cape Ann. Just off the “other Cape” in many North Shore towns, I saw lots of Brown, Tisei, and some Romney towns. But in Gloucester and Rockport it was Obama/Warren/Tierney to the max. What the hell? I thought Brown was helping fishermen etc (fishing towns). Once I crossed the Annisquam river it was back to GOP heaven.

So in MA, do you have to give up the voter regi you had when you changed sex, or do you get another, additional vote? This is a serious question, because my tribal sister Liz AKA Princess Fauxcahontas, is in the fight of her life in public service.

The scientifically conducted Kenny Bunk VFW* poll shows that 100.3% of transgendered individuals vote "Democrat." Two sexes: Two votes. Two section 8s, Two EBT cards. It's only fair.

*Data gathered from Males, Over 65, wearing a woolen shirt, stained khakis, steel-caps, who went to wrong precinct in 2010 before returning to VFW bar for directions but by time it got sorted out was too late to vote, but profess to be "Conservatives" and shout back at Rush Limbaugh.

And BTW, if I ever see a gathering of the tribe saluting us voters with Fauchahanta signs, I’ll make sure to pull over and chop and whoop to my heart’s content.

Why are Indians ‘offended’ by the Atlanta chop and not ‘offended’ by a white lady checking the box and taking away another’s chance at advancement?

Further, I hope someone’s tracking down Warren’s private law clients and getting them to sue her for misrepresentation.

Robert Berg, 49, of Dexter was arrested Sunday along with co-defendants Malcolm French, 50, of Enfield; Rodney Russell, 48, of South Thomaston; and Kendall Chase, 55, of Bradford. All four men along with Haynes Timberland Inc., a Maine corporation, were indicted on federal drug and other charges arising from the Sept. 22, 2009, seizure of nearly 3,000 marijuana plants.

Each pleaded not guilty to the charges lodged against them late Monday afternoon before U.S. Magistrate Judge Margaret Kravchuk, according to a previous report. All but Berg were released on bail.

Berg’s release was held up while firearms were removed from his home and deeds of trust to property he owns could be posted as bail.

Berg is the owner of Berg Sportswear, the Corinna business that does custom screenprinting and embroidery that was raided by federal investigators in January 2011. Documents made public in July 2011 indicated that investigators were looking for evidence that Berg was using logos for major sports teams illegally.

Investigators in January 2011 seized business records, computers and dozens of boxes of merchandise from the business and residence, according to a custody receipt for seized property and evidence filed in federal court in Bangor. In addition to those items, more than $38,000 in U.S. currency and $740 in Canadian cash was found and seized in safes in the garage of Berg’s home.

How that evidence is related to the charges on which Berg was indicted was not clear Wednesday.

When the marijuana operation was discovered in 2009 in Washington County, MDEA officials categorized the size, scope and detail of the operation as quite surprising. They said the plants — many of them 8 feet tall and highly cultivated — were of extremely high quality.

I have refused the Nobel. Nobel invented nitroglycerin, you know. Some foolish country doctor prescribed it for my Uncle Elmer. Unc immediately felt better upon lighting the fuse, but was left with a terminal headache.

Dr. said, "...why if brains was dynamite that Elmer couldn't blow his nose."

However, as I hunger for peer recognition, your kind note was much appreciated. The $25 is on the way as soon as sugarin' is over. Bout April be OK?

Couldn't these DEA people have waited another 60 days or so. Growin' season is short enough without all this federal interference.

NOTE TO FISHERMEN:

Please drag your nets around once in a while to show normal wear and tear. Also, hook up an old GM 61 to use when in earshot of shore. Them 2500-Hp two-stage Turbo MTU's is a dead giveaway to revenuers.
