But also..."charged w/ possession of a graffiti instrument." Is it a crime to be in possession of spray paint at all, or does that just kick in if you use it for a crime?

Is it a crime to be in possession of spray paint at all, or does that just kick in if you use it for a crime? Getting caught using it. Here in NJ some paint and hardware stores ask for I.D. if you appear to be under 18.
