And there LIES the rub. You'll notice that the article conveniently avoids marriage until later in the article. As you read the first paragraphs the writer purposely implies that UNMARRIED heterosexual couples between an American citizen and a foreign national entitles the non-citizen to be able to acquire a green card. Of course that is not true: the old ruse of marrying to get a green card has been played out in sitcom plots (and some dramas) multiple times over the last thirty years. But again the crux in our law (and the fictional Hollywood scripts) is that one needs to be married; this writer creates a false assertion via a lie.

It is not until the last few paragraphs that the heterosexual "advantage" is only noted when the Defense of Marriage Act comes into play. Thus until gay marriage is nationwide there is no legitimate legal federal way to declare married gay couples of citizen/foreign status to be legally entitled to access green card status while DOMA is still on the federal books.
