Sen. Graham: Obama move on defense layoff notices 'patently illegal'

Sen. Lindsey Graham (R-S.C.) says that he will do anything he can to block the Obama administration from reimbursing defense contractors for severance costs if the firms don’t send layoff notices to employees.

The Obama administration issued guidance Friday that said defense firms’ costs would be covered if they have to layoff workers due to canceled contracts under the across-the-board cuts set to take effect Jan. 2.

The layoff notices have become a politically charged issue because they could have come just four days ahead of the election because of a 60-day notice required by federal law for mass layoffs.

Graham and other Republicans were livid after the Obama administration issued the guidance on Friday telling contractors that their legal costs would be covered due to canceled contracts under sequestration, but only if they did not issue layoff notices before sequestration occurs — and before the November election.

“I will do everything in my power to make sure not one taxpayer dollar is spent reimbursing companies for failure to comply with WARN Act,” Graham told The Hill in a phone interview Monday. “That is so beyond the pale — I think it’s patently illegal.”

It is too late now but we are in the run-up to the debate and one can only ask where the hell are the surrogates raising issue after issue such as this illegal action by the Obama administration to set the predicate for an attack by Romney tomorrow night?

This is perhaps one of the most inept political campaigns since-well since John McCain.

It is not so much the campaign but the Republican Establishment as a whole doesn’t have the stones to lead. As we know, a leader does not need to know all the answers but he is adept at knowing where to find them at a moments notice.

We have had the warnings for months now that he was going to pull this. A leader would have nipped this in the bud long before he did it. Ghomer Graham is just doing his typical reactive whining after he is bitch slapped, yet again.

Obama is operating from that phrase that it is easier to get forgiveness than it is to get permission. The establishment operates from the position to shoot spit balls at an issue after an action because they know they can do nothing about it then.

It is called leading from the rear and Obama is trying his damnedest to be better at it than the Republican Establishment. It is a toss-up at who is better at it.

“The government said it would cover legal costs if contractors are forced to slash their payrolls because of the looming $109 billion in automatic cuts next year and are alleged to have violated the WARN Act.

The federal WARN Act requires businesses with more than 100 employees to notify workers at least 60 days in advance of a mass layoff or plant closing. Some states require more notice.

“Any resulting employee compensation costs for WARN Act liability as determined by a court, as well as attorneys’ fees and other litigation costs (irrespective of litigation outcome) would qualify as allowable costs and be covered by the contracting agency, if otherwise reasonable and allocable,” the Office of Management and Budget said in its guidance.

So obama promises to pay the legal fees resulting from companies breaking the law. Just to keep himself from looking bad for a few more months.

But there is no mention of the human misery to millions of employees and their families caught by short-notice layoffs and terminations. THAT is what the WARN act was supposed to protect against. Giving people adequate notice to prepare for unemployment.

Maybe a free obama phone will provide some solace.

I think it is a Union job. I mean, BushJr said it was the Mexicans to do the job that “Americans” will not do, because instead of blacks on welfare, he could only say “americans”, while liberals go on destroying by demanding a normalcy to slavery through special slave rights for gays and women and minorities in retribution, so as to later on make it a slave right for the upper up in power.
