No, no, you see he’s borrowing from “disperate impact” theory. It doesn’t matter whether free will is involved. If drug laws end up affecting black people at a statistically lopsided rate than no matter what happened between the law being passed and the present instant, nor whether it was intended that way, the law is racist.
