I suspect you are thinking of the "posse comitatus" act, much beloved by freepers. The act does not prohibit use of Army troops for domestic law enforcement, if authorized by Congress. Laws passed since 9/11 make these issues more ambiguous. I recall flying soon enough after 9/11 to see active duty troops at the airport. No one complained about violation of the law then.

If the MP's are just standing by in case a soldier needs to be taken into custody, which appears from the article to be the enabling mission explanation, it is doubtful that that would violate the law.

btw, little known, Marines are not covered under posse comitatus, nor are National Guard units.

Just a few years ago a mass murder happened in Alabama involving multiple crime scenes. The sheriff having only 1 deputy asking for help from the local military base to secure the sights. Later it was ruled by the courts to have been an illegal act.

Great response. No one said anything when my Marine battalion (2nd Bn 9th Marines) went into L.A. during the Rodney King riots. Between us and the National Guard, the B.S. stopped instantly. At no time did the military TAKE OVER civilian control: we were asked for by the Governor.

Posse Comitatus is not absolute, and there are benefits on both sides of the limiting factors in its use.

Courts have ruled otherwise. The National Guard is now part of the US Military. They no longer report to the Governor of their state.

Almost all the troops at the airports post 9-11, especially anyone actually empowered to do something about a threat, were National Guard in a Title 32 status.
