Original title: Romney's 'October surprise' WILL be released: Judge allows Mitt's secret evidence in bitter divorce of ex-Staples CEO to be made public
---------------------------
Celebrity attorney Gloria Allred has won her battle to have Mitt Romney's sworn testimony in the bitter divorce of the ex-Staples CEO released to the public - in what is claimed could provide a damaging blow to his campaign.

The Boston Globe filed the application to unseal the records and lift a gagging order on all parties involved after receiving a tip-off that there was 'juicy information about Romney' in the documents.

On Wednesday, there were claims that Romney's testimony in 1991 meant that Maureen Stemberg received a poor divorce settlement in the divorce from former Staples CEO Tom Stemberg after he said the company's stocks were 'overvalued'.

But Romney's lawyer said he would happily allow the transcripts to be released - leaving them to be left open to interpretation. The documents have yet to be seen by the press.

"Gloria went on then to ask Romney’s attorney if he cared if the gag order was lifted and the judge stopped her and said that Mitt wasn’t on the original contract of non-disclosure so his opinion really had no legal merit!"

The exact point of the discussion my wife and I had on this last night. Romney was never part of the original gag order. It should be the the couple who were divorced, and as long as one of them wants the gag order held, the courts will see it that way.

I also appreciate that the judge chastised Allred for trying something 18 years after the fact and close to an election.

The real take away is that Allred’s bimbo won’t be allowed to speak....she is still gagged AND Allred took a real slap down in court

THIS JUST IN...

A witness has come forward who states that in 1967 he saw Romney inflate his tires to 34 pounds, when the manufacturer only recommended 32 pounds.

He’ll be on CNN within the hour. MSNBC will be airing a two hour special tonight.

The Washington Post, New York Times, The Boston Globe, the Chicago Tribune, and the Los Angeles Times are clearing half the front page above the fold, for in depth coverage tomorrow morning.

FoxNews has said it won’t cover this silly scandal, but they are running a special on the dangers of over-inflation.

The gag orders aren’t being observed by Witch Sternberg anyway....she’s all over HuffPo with the most incoherent rants you can imagine.

nd I believe Allread claims that Romney lied under oath when he testified that Staples stock was “overvalued”. Then a few weeks later, he and the CEO sold their shares and supposedly made a killing. The ex-wife apparently made a poor decision and didn’t time her sale right, or didn’t have an advisor, or whatever, and she lost out on a “windfall”.

As I understand it, she got a bunch of shares in Staples, before it went public. Romney's testimony was about the value of the shares. I'm guessing, but I suspect it was to determine how to divide the marital assets.

She then sold some or even all of the shares shortly thereafter, at the pre-IPO price. That means she sold it to another insider, since they weren't marketable.

But, the pre-IPO price was much less than the IPO price when Staples went public. Don't hold me to these exact numbers, but they were in the vicinity of $2.00 pre-IPO, and $19 post-IPO. So, she left a lot of money on the table. I should point out that the difference is typical: non-marketable pre-IPO shares are deeply discounted, because you can't easily sell them.

What happened next is kind of murky, but I've read that she has been filing one suit after another to try to recover that loss, and has spent millions (to her attorneys), to no avail. So, saying she is "bitter" is probably a gross understatement.

From a related article on the TMZ site:

“8:30 AM PT — Gloria denied accusations she’s a “surrogate” for the Democratic party ... who’s only representing Stemberg in order to wreak havoc on the Romney campaign.”

Yeah, riiiiiiiiiiiight! BWAH-HAHAHAHA!

In a previous thread on this topic, a lawyerly sounding poster said if the records would be released based on political motive by a political, lawyer hack, then juris prudence would be put on it’s ear...
methinks the ear has been put on....

Every share of stock traded every day (billions and billions) is based on a disagreement on the value of the stock. The buyer believes the stock is more valuable than the cash and the seller believes it is less.

It’s impossible to “lie” about a valuation.

Guys, the gag order may be lifted later if Allred produces a motion. The Globe dropped their motion to drop the gag order, so Allred now has to come back again to move a drop of that motion.

I hope the judge orders the motion granted.....as of Nov. 7.

wow. That sounds great. From the Boston media outlets, it sounded like she could come back and submit a motion to lift the gag order. Is that what it sounded like to you?

I want to send that judge a list of this woman’s posts on Huff Post, but unfortunately, it doesn’t appear that she has a public email address unlike some judges.

Obviously there is nothing damaging in the testimony. All he was asked to do was give his opinion on the value of stock. Care to explain how a scandal can be made out of that?

If Romney fights to keep something as ridiculous as this a secret THEN the media slime could claim anything they want is in the testimony and attribute it to “sources”.

Are you suggesting Romney should not have signalled his approval? BTW, in the end Romney had no say in the matter since the gag order was not issued to him.
