Are they saying you can prosecute a retired military person under the UCMJ?

Good point. He is no longer in the military. How can he be held to military law? I’m assuming they aren’t going after him for Crimes Against Humanity.

Yes they can prosecute former military- retired or other separation designations if it is determined that the violations occurred while still on active duty. The military can and has yanked people back in to face prosecution. It is not common and I seriously doubt it would happen here but it is absolutely possible.

Maybe its different for officers. I know you can lose your retirement for a felony.
