S.F. wants Dodgers to pay fan's bill

San Francisco is seeking $1.2 million from the Los Angeles Dodgers in federal Bankruptcy Court to recoup unpaid medical costs for Bryan Stow, a Giants fan who was severely beaten by rival fans in the Dodger Stadium parking lot.

The city's effort - spelled out in recent court filings - follows the Stow family's lawsuit against the Dodgers in Los Angeles County Superior Court, claiming that lax security and other problems contributed to the March 2011 attack after an Opening Day game.

San Francisco has identified the Dodgers as potentially liable for Stow's bills, and is setting itself up as a creditor in bankruptcy proceedings that began last year under former club owner Frank McCourt.

Stow, a 43-year-old paramedic from Santa Cruz, suffered a near-fatal brain injury and is expected to be disabled for the rest of his life. Within weeks of the attack, he was transferred to San Francisco General Hospital, where he spent five months before being moved to a rehabilitation center.

Then under this precedent can mosques be sued for the criminal and terrorist actions of their faithful believers?

Shouldn’t the guy who was beaten be the one asking for the Dodgers to pay these medical bills? Also, San Fransisco is asking the Bankruptcy Court to rule that the Dodgers are liable. Whether the Dodgers are liable should be determined by a California state court.

Lax security in a parking lot? I realize that’s probably Dodgers’ property and they have some obligation to patrol it and keep the riffeaff out. But do you really have an expectation of security in a big open place which by design anyone can wander into?

It appears that the city missed the claims bar date, and the hearing is whether the city will be allowed to file a late filed claim. Even if the claim is allowed to be filed, it will still be subject to an objection by the debtor. And battles over the allowance of claims are fought in bankruptcy court.

There is a high, but not impossible, barrier for getting permission for a late filed claim. The only folks who are likely to make money here are the lawyers.

A father and two son’s murdered by an illegal felon in SF.
SF “we are not responsible” or something to that effect.
