Along with murder, Hasan is clearly, slam dunk guilty of terrorism and murder, with full premeditation. By calling this a “work place shooting,” the Government has jeopardized the whole case since they’ve taken his real motive off the table. Evidence of that motive being gone, the defense can run riot with all sorts of frivilous psychiatric defenses and very possibly beat the death penalty.
