NBC News and David Gregory: A legal problem or a journalism problem?
Washington Post ^ | 12/26/12 | Erik Wemple

NBC News has a problem. The question is whether it is a legal one or a journalistic one.

-snip-

The legal problem here is nearly self-confessed. D.C. code plainly prohibits magazines with capacities exceeding 10 rounds of ammunition. Of this regulation, “Meet the Press” cannot possibly claim ignorance or oversight.

You can bet that mag has already left D.C.

And is on its way to Obama's Muslim Brotherhood allies in Syria...

I don’t like these guys any more than you do, but prosecuting anyone over this steps way beyond the intent of the law.

To each his own, but I don’t subscribe to the ‘na na na na na na, they do it too’ game. I don’t change what I think is right or wrong just because of the players. The spirit of the DC law as not to arrest people carrying empty mags.

I share your contempt for the leftards, I just don’t agree with blind application of the law because we hate someone.

The spirit of the DC law as not to arrest people carrying empty mags.

The spirit of the DC law is to find out whether the person possessing the 30 round magazine also has a rifle and/or ammunition that is also illegal according to DC gun control laws. And whether that person is potentially trafficking in the same.

Sorry Skippy, the DC law is very clear that just having the mag, even without a rifle, is illegal. The liberal puke has to serve some hard time for his crimes.

This happened in Canada, but remember the story about the dad who was arrested and strip searched by the police for possession of a firearm because his 4 year old daughter drew a picture of her father using a gun to kill "monsters and bad guys". The father had no gun. He did own a nerf gun. Neither the school nor the police apologized for their jackboot tactics.

but an empty mag used as a prop is hardly worthy of discussion. The NRA's biggest complaint is that the government doesn't enforce the gun laws on the books. Perhaps if these liberals got a taste of their own stupid laws, they would focus on effective laws rather than the crap they are pushing now. He should be charged and convicted.

Again, they did it to show they believe they are above the law. They could have used a picture on a board or from a file photo but they instead chose to do this because they believed they could break the law and because they are elites, not suffer the same fate as any other average person.

When they break the law in your face and they do it on purpose, I don’t want them to get away with it. Because any of us who went on that show would not be able to.

Either we all live under the same stupid laws or we don’t. These are the people who voted for this law, they don’t get to break it just because they’re anti-2nd Amendment. that’s the same logic that only blacks can use certain english words because they’re black.

what is the intent of the law? What was his intent on showing the magazine on TV did he show where he got it from, how much it cost, who else handled it? how hard or easy it was to get? What happens since he is caught will they show him being arrested, searched, his house searched, the studios searched, his dog getting shot by police, booked into jail, his booking photo, his court appearance etc his jail roommate...as Paul Harvey would say and now the rest of the story....

Unlike you, I believe that if Gregory broke the law, then he should be prosecuted. I believe he knew what he was doing and didn’t care. He believes he is above the rest of us. This should be made a big deal off, because he would be making a big deal of it if the shoe was on the other foot.

We have to stop letting them get away with it.

It should also get him a record of ‘gun related crime’.

That should keep him off planes and have his press pass pulled.

I don't know about you, but I'm tired of these sanctimonious MSM twits preaching how others should live and what laws are good for them, but not having to follow the laws themselves. I relish the prospect of taking a draconian law and using it to bludgeon one of these elites. It leaves the MSM now in the untenable position of justifying why it wants to break laws to which it expects you and I to be held.

Further we now KNOW without doubt they did do this deliberately and with intent to shove it in our faces.

NBC was told by the Washington, D.C., police that it was “not permissible” to show a high-capacity gun magazine on air before Sunday’s “Meet the Press,” according to a statement Wednesday from the cops.

THEY DID IT ANYWAY. The rules do not apply to the fourth branch of government, the liberal elite of the MSM.

Would you like to modify your view on this particular incident, now knowing this information is not just speculation but confirmed fact?

Gregory is lucky to be alive after letting such a dangerous contraband weapon touch his skin! Seems like a few years in prison will be necessary to make him realize the severity of his actions.

There’s also CONSPIRACY to violate the DC statute that prohibits possession of the 30 round magazine. He was told explicitly by the DC police that the magazine was illegal and yet he and/or his staff procured the magazine and took possession of it anyway.

an assault magazine-deadly as can be!
absolutely, actions have consequeces and stupidity is no excuse neither is elitism...they asked for and were denied permission and ignored the law and went ahead...clearly prior intent to break the law and knowledge of the law has been shown.

What would happen if someone took the (empty) 30 round magazine to a local DC school to be used as a prop for a ‘show and tell’? What would the ‘spirit of the law’ be?

Mich Patriot said: "Trying to make something out of nothing is a libtard tactic, and one’s reduces credibility."

Here in the People's Republik of Kalifornia I am subject to about seventy pages of guns laws, most of them just as stupid and unConstitutional as the law apparently broken by Gregory.

What do you think would happen to me if I imported such a magazine into Kalifornia? Would I just be told that it was no big deal and to go on my way?

Kalifornia maintains a list of handguns that are legal to buy new. In one case, I believe, simply changing the color of the firearm, because that is a different model number, renders the handgun illegal to buy.

I own a semi-automatic rifle which is legal to own simply because of the name on the receiver. If the name was "Bushmaster", my gun would be illegal to own.

The penalties for violating these laws are not typically like getting a traffic ticket. Many are felonies and carry heavy fines and prison time along with lifetime loss of Second Amendment rights.

I would be delighted to see Gregory and NBC charged, see them make an emergency appeal to the U.S. Supreme Court, and have the court summarily declare the D.C. ban unConstitutional under the Second Amendment. That would solve all our problems, wouldn't it? If such a thing happened, I would send a Thank You card to Gregory.

But if Gregory isn't charged, then he has no standing to challenge this tyrannical law and there is no way that the Supreme Court would take up the matter.
