IRS Warns Employers: Do Not Try to Avoid ObamaCare Insurance Mandate

The Internal Revenue Service warned employers in a new regulatory proposal not to come up with clever schemes to avoid Obamacare’s employer health insurance mandate.

The IRS said it would soon issue “anti-abuse rules” to discourage employers from taking advantage of any regulatory loopholes.

“The Treasury Department and the IRS are aware of various structures being considered under which employers might use temporary staffing agencies (or other staffing agencies)… to evade application of section 4980H [the employer insurance mandate],” the IRS said in a proposed regulatory announcement issued December 28. …

The purpose of the requirement is to force employers to pay higher wages to the lower tiered workers, therefore it will force the employers to lower the wages of the upper tier workers! You know, the whole “equal pay” mantra....

The end result will just be higher prices for the goods or services provided by that employer, but that is only because they are evil and not willing to absorb those costs!

I figure that by Obama’s fourth term, they could be forcing our grandchildren to serve in government brothels for the amusement of federal employees.

And why not? Looks like they think they can do anything with us at this point, Constitution or not. Without the protection of the Bill of Rights, we are effectively slaves to the government.

When will the employees wake up and find they are now making a cap salary.

Union employees have always worked under a salary cap. Bad employees are so happy to have a salary floor under them that they don't care whether the good employees have a salary cap above them.

Obamacare has taken this attitude national.

You mean something like: "No insurance policy qualifies for Obamacare compliance, the government will no longer accept the payment of the non-compliance fine, therefore you are a felon and unable to vote or bear firearms without government approval. Have a nice day."

If that is the case, then we need to do less 'talking' and more planning and preparation, as there will be bloodshed.

Confiscation and re-purposing your offspring will be ruled a tax, not "involuntary servitude" by the Supreme Court.

Hmmm - loopholes in tax codes for decades and the politicians keep saying they'll do something about it, but since the loopholes exist, it's legal to use them. Loopholes in ObamaCare and the IRS threatens folks who decide to legally use said loopholes. What's wrong with this picture?

Yep. Single payer administered by a few of the old insurance companies. Those companies will glady kickback payola to the dem party to keep their fingers in the pie. And marxists will want the insurance company brands to create a veneer of private ownership in health care.

You both are apparently under the impression that ZeroCare is meant to provide GOOD medical care and insurance for people.

Wrong impression.

This is meant to accomplish long-time socialist objectives: equal sharing of misery - via miserable “insurance” and medical care, reducing people to the lowest common denominator - unless they are in the “elite” political class.

The IRS can speak, but a Tax Court decides. They don’t write the laws, they just enforce the code.

If it is allowable in the code, it is allowable in the code.

Let them stamp their feet until the bottom drops out. Go for it.
