DEVELOPING: Obama recess appointments unconstitutional, court

A federal appeals court has overturned President Obama’s controversial recess appointments from last year, arguing he abused his powers and acted when the Senate was not actually in a recess. The three-judge panel’s ruling is a major blow to Mr. Obama. The judges ruled that the appointments Mr. Obama made to the National Labor Relations Board are illegal, and the board no longer has a quorum to operate. But the ruling has even broader constitutional significance, with the judges arguing that the president’s recess appointment powers don’t apply to “intrasession” appointments — those made when Congress has left town for a few days or weeks.

Let’s hope this is a turning point.

Appeal to a full bench probably will not be overturned, as the three judge decision is based on solid facts and precedent.

I wonder if there were flies in the courtroom.

His Holiness Hussein will simply issue a disparaging statement blaming the panel for punishing him for acting too efficiently to overturn the evil Bush doctrines.

Actually, it overturns about 70 years worth of precedent. I think today's decision is the correct one, and that presidents have been getting away with unconstitutional recess appointments for 70 years. But this decision is a big deal. SCOTUS will have to take it up.

We’ll soon see whom and what exactly gets unraveled, whether it will be this sane judgement by a lower court, or Obama getting a well earned smack across the mouth.

5-4 in the Supreme Court overturns this ruling, or not.

He can just re-appoint them, because "advice and consent of the Senate" means Harry Reid's rubber-stamp (Mitch McConell made sure a Filibuster can't happen).

We now live in a Dictatorship, and if a Court Challenge was made to Executive Orders and their Legality, we could only win on the common sense solution with Scalia or Thomas, as the rest of the Obama-plants and the Leftists would not challenge the Mulatto Messiah on ANYTHING.

And why would a Federal court think Obama will follow any findings or orders of the court? He’s ignored them in the past, and nothing has happened to him.

Glad it wasn’t anything important since it only took the fools a year to rule.

Nothing bad happened like Boeing being strong armed by the union thugs with the endorsement of the Labor Board.

Hope these ass hat judges didn’t have any of their deliberations interrupted too long.
