NM House Judiciary Committee To Hold Public Hearing This Monday On Sweeping Gun Control Measure

House Bill 77, state Representative Miguel Garcia's sweeping gun control bill to regulate all private gun transfers, establish a state registry of lawful firearms owners and tax legal gun purchasers will be heard by the House Judiciary Committee on Monday, January 28, at 1:30 pm or upon adjournment of the House in Room 309 of the State Capitol in Santa Fe.

It is extremely important that as many people as possible attend and speak in opposition to this measure.  This committee normally asks for a show of hands in the room for and against bills, and then allows each person to stand up and briefly speak from their seat.  Arguments should be clear, concise and not repetitive.  Please speak to HB 77, not to other gun control proposals in Washington or other gun-related bills filed in New Mexico.

The Democrats in charge of the committee are hard-core liberals who are taking opportunity from the last Saturday's shooting of the Griego family in ABQ to put forth their anti-gun legislation.

(BTW - the mother and three children were killed by a .22 cal rifle; the father was killed with an assault rifle when he returned from overnight counseling at a homeless mission)

Any word from Governor Martinez on her stance on gun control?

As a supporter of the Second Amendment and holder of a concealed carry permit, it’s unlikely she would do anything to weaken gun rights.

The problem is that both chambers of the NM legislature are controlled by Dems with those from ABQ and Santa Fe having very liberal (read far-left) views. Susana has another two years in office before she is up for re-election. If the Dems pass this legislation, it is vetoed by the Governor, and she loses in 2014, then they no doubt will muster all their forces to pass it again for a sympathetic Rat governor (such as corrupt Richardson) to sign.

The good news is that gun rights are written into the state constitution (but that doesn’t stop libs - i.e. Obama, Biden, Feinstein, etc.) from trashing the federal 2nd Amendment. The other good news in the NM constitution is that legislative sessions are limited to 60-days in odd-numbered years and 30-days in even-numbered years. Legislation is often bottled up in committees such that the clock runs out (Thank God!).

Governor Martinez takes a stance with legs apart and well braced, the weapon raised to sighting level, with a firm grip of the stock, hold breath, and SQUEEZE the trigger, while braced aginst the recoil. Pull back bolt, ejecting the spent cartridge, and smoothly pushing in fresh round, then closing the bolt, preparing to taking aim again.

Or just have a 30-cartridge magazine to feed in the next round, continue to pull the trigger for each aimed shot, and watch the SOB fall down.

Stop shooting when you are out of ammunition.

If the 2nd Amendment says "the right of the people," doesn't that mean that the states cannot take that right away?

The 10th amendment says:

It seems to me that calling out "the right of the people" specifically in the 2nd amendment, the states are being "prohibited by it" according to the 10th amendment.

How long will it be before a state is taken to court over this?

New Mexico isn't going to be it; the New Mexico State Constitution, in Sec 6 of Art II, says the following:

[Right to bear arms.]
No law shall abridge the right of the citizen to keep and bear arms for security and defense, for lawful hunting and recreational use and for other lawful purposes, but nothing herein shall be held to permit the carrying of concealed weapons. No municipality or county shall regulate, in any way, an incident of the right to keep and bear arms. (As amended November 2, 1971 and November 2, 1986.)

So, as you can see, unless they're amending the State's own Constitution the proposed law is stillborn, being legal nullity.

Well, since these democrats are dancing on the blood of these latest victims, someone should take a page from PETA and throw bloon onto these committee members so they can do the dance for real. Water balloons full of blood might do the trick.
