Drakes Bay Oyster Co. goes to court to fight closure

Lawyers for the Drakes Bay Oyster Co. and Interior Secretary Ken Salazar will square off Friday before a federal judge in Oakland in the first round of a legal battle to continue the commercial oyster operation in the Point Reyes National Seashore.

At stake is Salazar's decision in November not to renew a 40-year lease that gave oyster farm operator Kevin Lunny the right to commercial operations in 2,500-acre Drakes Estero, a five-fingered estuary that features extensive eelgrass beds and a harbor seal colony.

The decision, hailed by wilderness advocates, gave Lunny's company 90 days to shut down a business that plants and harvests 8 million oysters — worth about $1.5 million a year — from the near-pristine estero. The deadline was subsequently extended to March 15.

Four days after Salazar's Nov. 29 decision, a Washington, D.C.-based nonprofit filed a federal lawsuit alleging it violated federal rules and was based on faulty science.

If I remember from a previous article, this was private land donated to government for a park with the proviso that the oysters could still be harvested/farmed.

Near-pristine? Pretty sure they’ve been harvesting since before it was declared protected, so obviously the commercial interests can operate without harming the environment.

U.S. District Court Judge Yvonne Gonzalez Rogers appeared to lean toward the government’s arguments to shut down the operation, but did not issue a ruling. That will come sometime in the coming weeks.

I searched the FEC database for contributions from Drake's Bay Oyster Farm (employer). It looks like only one employee made any donations and those totalled $600 for (uber-lib) Lynn Woolsey in 2006.

I hate to see anybody get shafted by gubbermint, but in this case, at least one of them got what he paid for.

Remember this folks, EVERYTHING these people are doing is for one intention only, and that is to PROVOKE We The People into becoming aggressive towards them. That is their Goal, they Want Civil War, in fact they NEED IT to cover up all the FRAUD in our financial system and our government. What we really need is lists of the People supporting this crap so WE THE PEOPLE can SHUN THEM FROM OUR SOCIETY. I started 30 years ago with Hollywood and never looked back. best decision I made.

Been there, another over reach by the Salazar empire. Next up will be the dairy farms that have been there since before 1850 and after that maybe they can get the tulee elk to be removed too as an evasive creature.

Anyone who thinks this is not government run amuck just has to follow some of these inane rulings by the land Nazis in DC.

I’ve had some of those oysters, they’re so big and fat you have to cut them in half to bread and fry them.
