This has some inherent legal problems, and it will be a good question whether it will stand up in court.

The basic problem is that, be it a hospital or someone renting an apartment, it is that they have no access to a means to determine if someone is illegal or not, if their ID is genuine or not.

Often people arrive in an ER without ID, either by accident or intentionally, may not be sound enough of mind to answer questions, and are likely “emergent”, needing treatment right now.

In other words, it is often chaotic. And on top of that, the government is asking them to do a law enforcement job with no means to do it.

A judge will have to determine all these things.
