Like its travel slogan says, Virginia is for lovers. But if said lovers are cohabitating outside marriage, they are currently breaking the law. But theres good news for those lawless lovebirds: State officials in the commonwealth are considering a bill that would legalize cohabitation.
Florida, Michigan and Mississippi have similar laws banning cohabitation.

So, does that mean Virginia will institute a Common Law provision?
It’s an irritating law. I have some girlfriends who have run into a problem with it. These are very normal, heterosexual ladies in their middle years, one divorced with grown children, one widowed. They’re best friends. They’re lonely. They want to rent a house in Richmond. But they’ve run into quite a few headaches because people assume they’re lesbians.
I’ve got the same question. I hope to move to Virginia soon and I might ask a lady friend to live with me. We are ardent, committed heterosexual ladies but realistically speaking, neither of us are going to find a nice Conservative Catholic guy to marry at this point, so we might want to live together. Women used to do this. But will this be a problem? I hate that everybody thinks that women who do stuff together have got to be lesbians. Can’t we just be girlfriends, like women used to be?
Big mistake if they do. Virginia’s law against cohabiting is never enforced, but it keeps the court system free of any lawsuits that arise from cohabitation. I say if it ain’t broke, don’t fix it. Keep Commonwealth law the way it is.
