The Environmental Protection Agencys brazen contempt for free-market economics evidently knows no bounds.
Less than a week ago, the Environmental Protection Agency received a slap on the wrist from a federal appeals court that ruled that the EPA may not force oil companies to pay for an credits for failing to comply with a rule mandating that they incorporate a certain amount of cellulosic biofuels into their product. The EPA estimated that the industry would produce and make available for purchase 8.7 million gallons of cellulosic biofuels in 2012, but the industry only actually produced less than 21,000 gallons and the court thankfully decided that the EPA could not inflict regulatory punishments based on their wildly enthusiastic and fanciful projections.
You know, government projections? Like how the Obama administration also projected that wed have positive fourth-quarter economic growth and that ObamaCare would reduce health care costs? Howd that work out for us?
EPA dont care, because this time no really, guys, this time they know what theyre doing.
EPA raised how much cellulosic biofuel those made from non-edible feedstock it expected refiners to blend this year as part of the renewable fuel standard.

The EPA is probably the biggest shakedown agency - and there are a “few” - in the Federal Government.

The Five Year Plan stated specifically that there would be 8.7 million gallons of cellulosic biofuels in 2012. So obviously the oil companies must buy those biofuels because that is what the regulations say. Its right there in black and white.
For those too young to remember the Soviet Union produced many Five Year Plans making overly optimistic predictions and goals for the production of everything from toilet paper to airplanes. The apparatchiks that failed to meet these goals were brought before the committees that produced these goals and made to explain their failures. Those who did not adequately explain their failing were frequently never heard from again. Consequently numbers were fudged and accounting methods adjusted to meet those goals at least on paper.
Let me see if I understand this correctly: EPA says 8.7 million gallons of a certain kind of ethanol (that which is produced from “non-food” grains) should have been purchased last year, but only 21,000 gallons have ever been produced, so therefore 14 million gallons must be purchased this year?
This isn’t logic, it’s a racket designed to create fines. I wonder if Chief Justice Roberts would call this a tax, because setting impossible goals in order to collect fines sure looks like one.
Obama burned more than 21,000 gallons during his campaign trip to Las Vegas yesterday.
EPA is an administrative agency. The Individual states need to tell the EPA to get f****d, and totally ignore their dercrees by unelected officials. They can make all the mandates they want, make them try to enforce those mandates. The only way they can enforce them is through fear and corruption.
Don’t forget the companies were also fined $6.8 million in penalties for not using the non-existent cellulosic ethanol.
Look for next years fines to be larger since they will miss the target by even more.
Next year, 2014, the EPA is going to require of oil companies the production of 1,000,000 tons of dilithium crystals for use in warp cores. They will also be required to produce enough warp cores to produced all the energy required by the US.
The fine for failing to produce is that the government takes over the company.
In 2015, warp cores and dilithium crystals will be made illegal because they are known carcinogens to the State of California. The oil companies will be required to collect all remaining dilithium crystals and warp cores. These must be buried in the center of the earth by the end of the year.
Also required in 2015 will be the production of 150 million perpetual motion machines capable of running a 20 kW electrical generator. One of these must be provided for free to every family in the US.
The fine for failing to produce is that the government takes over the company.
In 2016, they will be required to make one for every family in the world.
But this will not happen since all of the companies will be gone, as planned.
