It is my understanding that “burner” is slang for tear gas. I thought it was also reported that there was a single gunshot about the time the tear gas was thrown into the window. I assume this gun shot was Dorner opting out.
I don’t care how crazy you are, if you are the occupant of a small cabin and it’s starting to burn then you will run out (unless you are already dead) I think the argument can be made that they tried to burn, or smoke Dorner out. I don’t know if that is a huge deal.

I know of at least one police department that is required to have the fire department on standby before they use it.
That it contains teargas provides a legal fig-leaf for the department. The fact that they call it a burner demonstrates that they KNOW it's a fire starter.
So does the requirement that the FD be there.
I don't know if the SBPD uses Flite-Rites or other less dangerous tear gas delivery systems. I do know that they call what they used "burners", and I do know that there was a fire.
