Supreme Court Justice Sonia Sotomayor upbraided a federal prosecutor Monday for asking racially-charged questions in court.
The justices almost never elaborate on cases they decline to hear, but Sotomayor took the unusual step of issuing a statement condemning the prosecutor, whom she did not name.
She said the prosecutor "tapped into a deep and sorry vein of racial prejudice that has run through the history of criminal justice in our nation."
The prosecutor in the case invoked racial stereotypes in questioning the defendant's explanation.
Youve got African Americans, youve got Hispanics, youve got a bag full of money. Does that tell you a light bulb doesnt go off in your head and say, This is a drug deal?" the prosecutor asked.
Sotomayor harshly criticized the questioning in a statement sharing the Supreme Court's decision not to hear an appeal from the defendant.
"Such conduct diminishes the dignity of our criminal justice system and undermines respect for the rule of law," Sotomayor wrote. "We expect the government to seek justice, not to fan the flames of fear and prejudice."
Justice Stephen Breyer joined her statement.

By the way, I did a quick search for the once-prolfic video of Sotomayor's racist and sexist remarks...and somehow, it appears that video has been SCRUBBED FROM THE INTERNET....
Yes, by all means, let’s resort to the childish notion that if we bury our heads in the sand, no one can see us; likewise, that if we ignore racial differences, then they don’t exist.
And, by the way, let’s ignore, too, that: 1. Blacks are the most egregious and obvious racists in the US; 2. Racial set-asides and racial spoils now virtually guarantee discrimination in favor of Blacks and against all other races; and, 3. Obama has set race relations in the U.S back by a good twenty years, probably more.

For all we know, they legally earned that money for a local orphanage that had fallen on hard times and they were on their way to the supermarket so they could buy food for those poor hungry children.

Gee! Does this stupid woman think they simply pooled their money and put it into a paper bag? Did she stop to think that maybe it might be drug money? How about income from a communal Obama work project? Yeah, that’s the reason.

Seems pretty obvious to me what the police were thinking.
“Innocent until proven guilty” didn’t cross Sotomayor’s biased mind. The cops? Yes they were suspicious and had a pretty good reason to be. They prosecuter just summerized the obvious.
All should matter in a court of law is right or wrong. So, let the attorney argue his case, then judge it on the merits of the argument. Sotomayor, shut up. Is that racist to say that?
Interesting that someone so “wise” doesn’t realize that provocative questioning is a standard way to get liars riled enough for some truth to spill out. I presume prosecutors must now tie their tongues behind their backs, lest the accused be offended.
If it’s true is it still racist? Are we supposed to lie and say everything is hunky dory just to avoid pointing out that blacks and mexicans with a paper bag full of cash are going to be involved in a crime well over 99% of the time?

Would 'The Wise Latina' have been happier with a question to the defendant like this:

Did you think that it was from a fund raiser for an upcoming 'Rap and Cinco de Mayo Celebrate Diversity Festival', or a light bulb goes off that says, This is a drug deal"?That would have been pretty politically correct so there shouldn't have been a problem. But even if the defense found it racially offensive there's that legal thingy in court that lawyers use called, 'An Objection'. Which by the way, the defense lawyer didn't raise after the original 'offensive' question was asked in court and is why the appeal was fricken denied by SCOTUS anyway which included her.
Plus I'm sure during her vast legal career as a lawyer and time on the bench as a judge 'The Wise Latina' has heard a lot more offensive, inappropriate, misleading, etc, etc, questions by BOTH sides than what was asked. Including lawyers like herself!
There are quite a few things diminishing our criminal justice system. This is the least of them.
