Judicial nomination held over for U.S. Attorney in Reese case

The Senate Judiciary Committee “held over” the nomination of United States Attorney Kenneth J. Gonzales to be a U.S. District Judge for the District of New Mexico district yesterday. Nominated by President Barack Obama last November, Gonzales’s suitability for the post may be under scrutiny due to the way his office has handled the prosecution of the Reese family on gun and money laundering charges.

These former Deming gun dealers have undergone a nightmare ordeal for the past year-and-a-half on charges they were ultimately acquitted of or had dismissed, except for a handful of remaining counts, where they were held responsible for federal agents lying on firearms purchases. Following revelations that neither the defense nor the jury were informed by the prosecutor that a key law enforcement witness against the Reese family was himself under criminal investigation and that “might have shaded his testimony to curry favor with federal prosecutors,” Judge Robert C. Brack ordered a new trial.

The defense has since filed a motion for dismissal, citing similar past cases to demonstrate a “pattern and practice of the U.S. Attorney’s Office in not disclosing what is constitutionally required.” They’re also requesting to subpoena Gonzales and others in his office for an evidentiary hearing to answer for a “constellation of mishaps … sufficient to show a pattern of practice that constitutes either intentional or reckless ignorance of their constitutional obligations to Americans when they are charged with a crime in order that a fair trial may unfold and a true verdict can be rendered.”

After the abuse of the Reese family, Kenneth Gonzalez should never be allowed to be a judge. I think he should be on trial himself. I took the few minutes to send an Email to Senator Grassley, who is showing some spine on this. We should encourage him.
