Sumner County law enforcement authorities said they finished their investigation of a fatal shooting Monday night in which a 41-year-old man from Iowa was shot by a farmer.
Sumner County Sheriff Darren Chambers said no arrests will be made in Mondays shooting, and that the farmer shot the man in self-defense.
Were not going to pursue criminal charges, Chambers said. Based on the scene and a witness and the history of the gentleman, we dont feel this was anything more than self-defense.
The Kansas Highway Patrol had been looking for the 41-year-old man, who Chambers said had several warrants out for his arrest in Iowa, shortly before noon. The man had driven through a Kansas Turnpike tollbooth without paying. His car, which Chambers said was stolen from Indiana, was found abandoned a short time later. He was seen running into a wooded area near the tollbooth.
Kansas Highway Patrol authorities searched for the man with a patrol plane and by car without any result.
The shooting happened shortly after 5 p.m. at a farmhouse east of the turnpike, near South Haven.
Shortly after noon, law enforcement authorities had gone door to door in the area advising residents to be on the lookout for the man. And shortly after 5 p.m., the Sumner Countys Sheriffs Office received the call from an area farmer who had been out burning hedgerows saying hed seen the man walking near his farm.
The farmer reported he had watched the man run across the turnpike, then realized one of his relatives might be danger.
According to Chambers the farmer and his 17-year-old son went to the relatives farmhouse and made sure the house was secure. The farmer was checking the outbuildings when the 41-year-old man attacked him, he said.
The farmer shot the man with a shotgun and killed him, the sheriff said.
Chambers said late Monday that the case has been turned over to Sumner County District Attorney Kerwin Spencer.
Uncle Joe gave good advice, “Use a Shotgun”!
Damn nice this was outdoors, no reason to destroy a good door. Also saved the State / County from paying Perps, Medical, Room and Board for years.
Great story. This one is going to drive liberals nuts, because it will always be this farmer’s word against the dead perp... Libs will forever think the perp should have had a chance.
