In his ruling, Judge Tingling found the Board of Health's mission is to protect New Yorkers by providing regulations that protect against diseases. Those powers, he argued, don't include the authority to "limit or ban a legal item under the guise of 'controlling chronic disease.'

Thank God there is a sane judge out there. Nanny Bloomberg takes a law that permits regulators to control chronic diseases and applies it to whatever he doesn't like. Large sodas can cause obesity if you drink a bunch of them. Steak dinners can cause obesity if you eat a bunch of them too.

Every single restaurant in the NY should be giving away FREE super-duper HUGE sodas tomorrow,,call them ‘Liberty Sodas” and hopefully Facebook and youtube will be flooded with people drinking them!

ah man! I was hoping to open up a chain of store right on the other side of the city limit selling everything bloombing idiot is banning! with signs saying things like... last place to get a decent size drink before you enter the nanny state zone!

As you basically acknowledge, that’s not the issue.

I do drink soda - diet soda. Not that it’s any of Bloomberg’s business.

1. It is a huge overstep of governmental authority. The only public health issues we might talk about them addressing would be those who afflict others not involved. Like coughing on a crowded bus when you have TB. Or boinking when you have AIDS (which is apparently no concern of Mr. Bloomberg).

2. It is an attack on the poor. Giant lattes, slushy margaritas, italian sodas with cream at a restaurant - all ok. But the poor guy who wants a Big Gulp or the low income mom who wants to split up a big soda for her kids for a treat (I used to do this) - oh no, that’s against the law.

3. It’s a total joke as to enforceability. All you have to do is buy two, or get a refill, or whatever. It’s just a hassle maneuver that also costs more for those who dare drink something that apparently Mr. Bloomberg does not care to drink. I’ll bet his double martinis have more calories.

4. It is not even logical. The danger to anyone’s health over drinking a given 32 oz soda is far less than smoking a cig, smoking a joint, having anonymous sex, driving a race car, having a drink of hard liquor, or for that matter drinking something you are allergic to. Yet none of the above is against the law.

Up next on the liberal agenda:

- Imposing a tax on individuals without a gym membership.

- Issuing summons for trick or treating, Easter baskets and birthday parties with cake.

- Taking kids away from parents who treat their kids to McDonalds for lunch.

- Reduced sentencing for convicted pedafiles who use healthy treats to lure children into their vans.

It would be better for it to get more and more onerous for free people to live in NY so that more will leave for freer pastures.

We all know those types of people bring their voting tendencies with them, causing the same crap to propagate all around the country.

I'm not saying that's false, but do you have a link to that information? I find that incredibly sad, since I read my first sci-fi book at age 11, a book that's considered young adult by some, but which contains very, very mature situations.

Bloomers is a Crony-capitalist, nebbish, poor little rich boy, self hating jew, tiny buttwipe of a man...the only reason he is probably not a fag (the jury is still out) is that he has the greatest aphrodisiac of all time, billions of dollars....he decries the 2nd amendment, but whines about how the enemy’s first amendment rights to worship are being usurped....even though Islam is NOT a religion but a murder cult.....and dont get me started on salt, transfats, cigarettes and sugar
